Sam y Nidia,

Buena suerte!!!

Dre

Thanks to all the wishes of support. We had our lab & medical exam yesterday. We picked up the results today and everything was fine. One odd thing was that the DS156 was not asked for by Dra. Gonzales. We later called once we realized this and were told things at the consulate have changed as of 2 weeks ago. And that both DS156 were to be turned in together at the interview, apart from the medical exam envelope. I will be writing an extensive report on everything after we get approved tomorrow, God willing. Thanks to all once again.....and Bogota is tooooooooooo coldddd!!!!!!!!!!!!!

Hola Chester....

Fiance went to have Registros Civil De Nacimiento for her and the children translated and certified in Bogota. (Which by the way was 1/10 the price and 1/7 the time quoted in Cucuta.) She was told that the dates (I assume las fechas de inscripcion) of the registros were too old (2004 & 2006) and she must get new ones. Which I think means a trip back to Cucuta to get updated registros. So my bright idea of telling her to wait until she moved to Bogota to have the documents translated has back fired.

Does this sound right? Do registros expire? Is there a way to renew one without travelling back to the place where it was issued?

I can't seem to grasp the Colombian system. There does not seem to be such a thing as an orignal birth certificate. There is only el registro which is created by the notaria and eventually becomes out of date.

What happens when she gets to the states and needs a birth certificate? Will a registro be accepted as a birth certificate and will it periodically need to be renewed? If someone moves from one end of Colombia to the other do they need to return to where they were born every few years to get an updated registro? That sounds crazy to me.

What is the latest on the need to submit the beneficiary's birth certificate with the I-129F? Required, not required or might be required? If I submit the I-129F without the beneficiary's birth certificate and it turns out they require it, will I lose any more time than the 3 weeks or so it is going to take to get the new registro from Cucuta and back to me in the US?

Thanks!

As far as I know, the instructions in the I-129f do not require a beneficiary's birth certificate. That's pretty much the latest.

A civil registry of birth should also be good for the life of the paper and ink on the registry. You're only born once. Maybe some more information as to why they told her she'd have to get a new one?

Maviwaro,

Thanks for the reply.

As to why the translator wants new registros, as I stated they said the dates were too old and they want them dated in 2007. That is all the information I have.

I agree that the I-129F instructions do not request the beneficiary's birth certificate. But I also think that I have seen multiple posts that stated that some applicants received an RFE and were asked to provide the document.

So, I am trying to determine if I should submit the I-129F now and risk the RFE or wait until we have an updated & translated registro to submit with the application. To me it comes down to how much time is lost when an RFE is issued. If it is only a couple of weeks, I think I should submit the application without the beneficiary's birth certificate and risk the RFE.

Thanks again.

Sounds silly to me, Kurios. A translator is not a US Gov't official and is not authorized to make such demands.

RFE requests on an I-129f revolve around the petitioner's role in providing clear evidence of the relationship to make a judgement more straightforward. I did not include my fiancee's birth certificate in the I-129f packet and have not heard of that happening in any RFE situation for anyone else here. The certificate, in Spanish, is needed for the US Embassy for the interview itself. No translation needed for that at all.

What you will need a translation of said document, as well as anything you plan on using as evidence, is for the Adjustment of Status process once you get married. And again, no translator can make that kind of demand for a translation- it seems to me that all you have to do is remind the translator that you can always use someone else's services for a similar price. This is Colombia after all.

Wishing you ten-fold that which you wish upon all others.

Yes, the Pasado Judicial is the police report. And yes you get the carta de entradas y salidas from DAS. The cost should be in the neighborhood of 30,000 to 32,000 pesos ($15 to $16).
