Mystery-

Fingers crossed for you today...hope everything goes smooth and easy. You're probably in the interview right now actually.

Has anyone applying for a K1 visa on this thread been requested to show specifically this certificado migratorio? Again, we do plan on going to Bogota to get it when we find out the interview date, but I'm just curious if anyone has a real story on this. Originally they said it was just for people who had been out of the Colombia for 6 months or more, so not sure why this requirement was changed.

We're going to get it because it's not worth the risk not having it I think, but I'm not sure I understand the rationale of the requirement of the DAS Certificado Migratorio if my fiance hasn't left the country more than once in her life and has her exit and entry stamps clearly marked. I guess this is more of a gripe than a question, ha ha.

how could this certificate be of any help to the embassy when she left colombia for 6 days once to go to argentina?

Hola!

I'm new posting but I've been reading the forum for a couple of months,

This is forum really helpful, I know pretty much everything that I have to do thanks to you guys,

Now, I have a big question, I was in and out of the States when I was a minor, but unfortunately I overstayed my visa when I was there, (I was only 13!) but now that I'm looking at the paperwork I have to fill out, the form DS-156 asks if I've overstayed any previous visas... I want to answer "no" but I'm not sure if that's ok. I've been reading a lot, and any "unlawful" time under the age 18 doesn't count, but the forms ask all these specific questions I don't really know how to answer,

I just got my NOA2 last week, now I'm waiting for the package,

Any comments on my case?

Silvia's going to get the vaccines starting this week so we have enough time for that follow up. The info about the second dose is priceless!

Well, I am not an attorney and am surely no expert on this, BUT....I would highly recommend that you do not "cover up" anything. Answer the question "yes" because you did overstay. However, what I would then recommend is that you include an attachment with the petition explaining the situation and your age. The last thing you want to do is have your petitioned denied because the government discovered that one of your responses is fraudulent.

Darolina, you may want to visit the WAIVERS forum and read some of the threads in there. You will find many folks that checked no to that question or covered up a previous visit to the US and guess what, they were held up in Administrative Processing (VISA LIMBO) or denied outright. I would follow Mikes advise, talk to an attorney first or check yes and attach a detailed explination. If you were underage, you had little choice of leaving or staying, assuming your parents/gaurdians were with you or in control of your exits and entries in the US. I'm sure the consul will understand that and not hold it against you. But like mother says...Honesty is the BEST POLICY.

Hey man...glad things seem to be going well for you! I will be flying in to Bogota on the 28th. Will be there through the 2nd, then off to Barranquilla for another 7 days and hopefully returning here to Ft. Lauderdale with Vicky!

I wanted to expand-on and/or question a few things you wrote:

1. I am renting the SAME place as you I believe - in case others are interested, this place can be found at http://www.welovebogota.com/ and if they do not have any rooms booked, you can talk them into the WHOLE apartment for $50.00 a night. If it is the same place, dont trash it before WE get there! jajajaja

2. Medical - FIRST a question...was it necessary to have a DS-230 form filled out for this? Vicky chose the other doctor listed and they want her to have this? Not sure why, but we will. COMMENT...the other doctor listed (NOT Gonzalez) will do an appointment and results same day. We have the appt. on Tuesday and are arriving on the weekend, so Gonzalez said it was impossible to get results in time but the other office (sorry, I forget the name but it is listed in the packet) will do medico and results same day, and our appt. is at 4pm!!!

3. Certificado del Migratorio - QUESTION....is this the same DAS form listed in the packet instructions or something new? Vicky paid a fee in a bank then visited DAS to get a certificate (a little booklet) but she didnt get it in Bogota and they didnt seal anything. Know if this is the same thing? She said it is alike a record that shows any entry/exit to other countries - assuming Migratorio?

1. Yes!! Thats the apt!!!! LOL, don't worry man I'll keep it clean for ya. Dude you'll be glad you stay here. The new payment center for the VISA (which is 240.000 cop) is one block away. The embassy is 2 blocks away.

2. I did not have to show the 230 form. Only the sheet with the interview date on it that comes in Packet 4. The DS 156 and 2 pictures in the Doctors office. We used the female Dr. So maybe the other doctor does it differently, not sure. BUt if thats what they asked for , take it!!!

3. Dude I'm not sure I follow you good here. But you need TWO certificates from DAS. One is green and looks like a little folded up card, that is the Judicial one. The other one is the Migratorio one which comes in a sealed envelope (and they told my fiance NOT to open it). This is the one that shows entries and exits from Colombia. Get them both!! Because it is in the list. We were not specifically asked for it and nor was it on the list of things that the embassy gives you there when you get there. But we included it and they stayed with it.

Congratukations on your approval! Hopefully you will not have any problems picking up your VISA tomorrow, unlike us! My wife will be back at the embassy today at 4:00 P. M. in hopes that her VISA was printed out. Yesterday they told her that her VISA was not released by the computer system. I called this morning and spoke with a supervisor and she said sometimes the name check is not complete when they approve the VISA at the interview. So, she took my phone number down and my wifes name and said she would give us special handling! yea right! But she said there was nothing else they could do. My wife said there was another there in the same predictament and yesterday was his third day of being told it still was not released. The guy told the consular that he had already changed his flight twice and it was costing him a lot of money. My wife had to do the same thing. I can not believe they jerk people around like this and can not even tell you the hold up!

The information that we've all seen and share on this thread seems to indicate that you can get the DAS report on entries and exits from any where in Colombia....but that it often takes weeks to get. Hence the reason that most go to Bogota and are able to get it in about 3 days. The Certificado de Migratorio is the exit/entry report. What exactly did the local office give you?

Hopefully she gets it today buddy. The embassy is closed tmw Thurs for some reason. We have to pick up our visa on Fri 4pm, which sux also. And I hope I get it because if not then I have to wait until Monday.....

All I know is that for K-1 applicants it is now a requirement. But I am not sure for CR-1's.

I had the old Packet 4 from PeterMiami and compared it to the one my fiance got for our Jan 24 interview and it is something that is new. Was not in the old Packet 4.

Funny thing is that when you're at the embassy awaiting your interview, they give you a folder with a paper telling you exactly how to organize your papers and in what order. In that list there is NO mention of the Certificado Migratorio. But we still put it in there. One of the required papers is any unlawful entries or exits from USA, thats where I put the Certificado Migratorio.

The interviewing officer said nothing of it, but did keep the document. A previous poster named Racerx07 said they never asked him for it, so he never gave it and he was approved.

So what can I say?? Its kinda up in the air. My suggestion would be that if your wife has time to get to Bogota in the next few days do it and get it.....just to be safe. My fiance got there last Thursday, went to DAS that afternoon and we picked it up on Monday......

I wish I can be of better help...but I can't buddy...good luck

We already bought the tickets and our interview is on a tuesday, so we are arriving on Sunday...we only had 2.5 weeks notice on the interview!

I am just trying to figure out if what she has is what she needs. According to the packet list, she has the right DAS document but that list says NOTHING about a "Certificado del Migratorio" specifically....

Any thoughts? Open to all experiences and options...trying to contact Vicky now because she has been trying to contact the Embassy all afternoon.

If its green thats the judicial one not the Migratory......although when they gave us the Migratorio one it was in a sealed envelope and they told us NOT to open it.....But that one looked like a just a sheet of paper not a small card like the green judicial one

06/19/06 - I-129f rec'vd by TSC

06/29/06 - NOA1

09/12/06 - NOA2

01/24/07 - Interview APPROVED!

01/30/07 - Returned to US with fiance

02/15/07 - Married

AOS Timeline:

04/24/07 - AOS/EAD mailed out

06/06/07 - Biometrics done

06/21/07 - I-485 APPROVED!!
