Hey everybody. Sorry to change the subject, but I need help. I have waited 150 days for my NOA-2 only to receive an RFE. Let me explain what the RFE is for:

My novia's husband was killed in Colombia and we sent in a copy of the Registro Civil de Defuncion for proof that she is not married and that her husband is deceased. Is this the correct document, or do we need to obtain the Certificado de Defuncion? From what I can tell, both documents say the same thing.

The RFE states:

DIVORCE/DEATH CERTIFICATE: Submit a legible final certified copy of the death certificate or divorce decree that has been filed in any Civil Court and signed by a judge or a legal authority showing the following prior marriage (s) were legally terminated for **** and ****.

I did send in the Registro Civil de Defuncion, what else are they asking for? Is there something else that I need to add with this form showing the marriage was terminated because of her spouses death? Doesn't a Registro Civil de Defuncion constitute her not being married and prove her husband is deceased?

Also, they asked for another document to be translated from Spanish to English. Can I translate it myself and send in the corrected information? I know how to translate the information, so can I do it?

Please, please, please help me! I need to get this RFE info sent soon so I can be with my love!

Hi all. Well, we got some interesting and disheartening news on Saturday. I once again received the entire AOS packet back as rejected. THIS time they said that the postmark was okay, but I had paid too much with the check. Their addition showed we owed $200 less than what my check was for. I have no idea how that would be possible, but what really astounds me is that they say I need to now use the NEW fees (over $3000 for Lorena and the boys). Why in the (*&* didn't they just use the extra $200 to have a nice little office party??? I paid too much so now I get to pay even more!!

I will again write to my US Senator, though I'm certain it will do no good. If and when Lorena ever gets her work permit (that's been three months already), we will start saving money to resubmit the AOS paperwork next summer.

Word of advice to anyone considering the K-3 route: DON'T DO IT IF YOU CAN FIND ANOTHER WAY!!!!!! Nothing against K-1s, but it seems really strange to me that a fiance can get a work permit, Social Security Number, and damned near anything else, in only a three or four weeks (if not right off the plane), but a spouse is treated like Typhoid Annie.

Okay, done venting (we stopped crying yesterday). Hope all is going well for everyone and we'll keep you informed when and if things change.

Greetings all, this is a great forum and I appreciate all the help from those that came before us. My question regards the baptismal certificate for Colombia. Hey Charles...

Words cannot express the complete and utter stupidity that USCIS is practicing on your case... OK, to be more fair... at least one or two different adjudicators are really royally screwing this up for your family. Do not give up hope on your elected officials and do repeat to them that this is the SECOND time you contact them due to USCIS inefficiency. Request an expedited handling of your case since this is now the second time some dopehead over there screws things up.

Or at the least, if they can't refund you $200 then their rejection must be based as an RFE in the form of a fee correction on your part... this doesn't make any sense to those of us with brains but maybe in their own crazy logic they are rejecting this based on a correct filing fee. Still, contact your politicians...

Had you heard of this before? Specifically: no touches, no updates, no email notice... this worries me a little bit, because (before finding VJ) I decided to use some lawyers to help me get the K3. In other words, if they mail my notice, it will go straight to my lawyers, and based on previous experience, it may well be sitting in their office for weeks before they decide to give me a call (I refuse to call them, cause every single call costs a lot). Oh, if I had only known what I know now, after reading the Colombia thread.

Anyway, I guess I can always call USCIS for an update. Just wanted to give you the heads up about the "no touches, no updates, no email" situation.

Yes, I've heard of this before and it is quite common. If I were you I would call the USCIS every now and then to find out since your lawyer might not be up with it to find out what is going on. And yes, he will get the NOA2.

Hi all...First of all i had a great time with Leidy in Panama....got back yesterday to be swamped with work.. :wacko:

Ok, now the bad part ...like Bundy, after waiting 154 days i tried the RFE trick for like the 100th time and yesterday they told me that on the 18th of October a RFE was sent out... :crying: .....The part that is frustrating for me is that when they sent my NOA1 to me , my lawyer let it sit on her desk for almost 2 months before i knew about it!!! :angry: ..The only reason she ever sent it wasbecause thanks to Lucho's advice about looking for my canceled check, i knew they had sent it to me so i called the lawyer....her response was that she still had nothing....strangely enough the very next day it arrived in the mail from her office... :blink: ....So this is the reasn im worried because i hope the same thing doesnyt happen with my RFE....I already called the lawyer and got on her case letting her know that i know they sent it and the date they sent it, so that she knows to stay on top of things...We'll see???? :unsure: .....

So the journey continues, i havecome this far, at least i know that my petition is not sitting in a box not being touched!!!

Byron, good to hear you had a great time in Panama!!

My lawyer has been so so to date. I hired them to complete through the AOS process. They were not any help after the initial filing and the papers went to Colombia. I felt they could have been more informed on the process in Colombia. This site helped more then anything. On the down side though..............my attorneys office has been evacuated cuz of the fires in Southern California. It is possible that it is all ashes now. I hope they had some way of securing all the records. I will have to wait it out and see what happens.

I hope you get your RFE soon and make sure you take care of it ASAP because you will get approved right after it's all cleared up.
