Interview for IR-1/CR-1

My husband currently resides in Mission B.C. but Vancouver only does the interview for K-3 and we would like to follow the I-130 route to get his visa. If the interview is in Montreal that is about a $1500 round trip ticket for us. My question, I have read that if your spouse is in the US legally you can interview in the US, can you request to interview in the US? My husband comes across the border with a I-94 card and it states the day he came and when he is required to leave, we have always followed this and been honest at the border in all they have asked, never have had a problem. My husband has been coming back and forth for almost 2 years, we have been married for almost a year. Has anyone ever asked for the interview to be in the US?

In your circumstance the interview for CR-1 would be conducted in Montreal.

I think you may be confused on the requirements with a different type scenario. If a couple met and were married (with no previous intention of getting married) and residing in the US they would apply and be interviewed in the US. There is specific criteria that has to be met or it could be construed as visa fraud.

In your case - you are married and your husband resides in Canada. I am not aware of any provisions in your situation that would permit the interview to be conducted in the US.

I'm not so great at explaining things - have your read throught he guides section here on VJ. Maybe someone can explain it better - its been an extremely long and challenging day.

Bernie C is correct, your husband would have to interview in Montreal. It is the only consulate in Canada that interviews for Cr1/IR1 visas.

I think as Bernie stated above you are confusing it with a situation whereby you marry (with no previous intention of getting married) and residing in the US would then apply for adjustment of status and would then interviewed in the US.

For those filers living in the western portions of Canada it certainly is an inconvenience, not to mention a huge additional cost but unfortunately that is the way things work at this point. Good luck!

OBX and Bernie are both right. Your husband will also need to have the medical done by a physicial approved by USCIS - there is one in Vancouver, one in Toronto and 2 in Montreal. While the cost of the trip to Montreal is expensive, so is adjusting status from a K-3 visa. Your husband will interview in Montreal - no way he can interview in the US that I'm aware of

I'm in Kamloops BC - I have to interview in Montreal (once they schedule me) and I'll do the medical at Woking Medical in Vancouver. Can't get around the consulate issue if you live in Canada and go the CR1/IR1 route.
