Drivers License New York with AOS Pending

First off what a great forum!

I was an F-1 student who recently got married to a US citizen and filed my I-130 and all relevant documents for the I-485 this week. Will I be able to obtain a drivers license in NY if I had a previous license that has not been expired for more than a year with proof that I am married to a US citizen and submitted my documents for residency and therefore in the country legally? I sent an email and they had mentioned I only need to bring my SS card, my expired license and proof of my name such as a birth certificate or passport.

My lawyer advised that its worth taking a shot...just not sure. Anyone had any experience with this?

04/09/2010 - Got Married

05/19/2010 - Papers filed

05/27/2010 - Receipt Notices

06/16/2010 - Biometrics Completed

06/27/2010 - Payment resent after error on my part

06/30/2010 - Case resumed processing and transferred to NBC
