Hi everyone. Im trying to get everything organized in my AOS and I-130 package to send into the USCIS but im catching a snag with the I-864 (affidavit of support.) I am 21 years old and I have been working for family since I was 15 years old, during that time although it isnt the smartest plan for my future, I have been paid in cash. I am not on a 1099 and i dont file a W-2. I have spoken with my employer and we are going to start taking taxes out of my check starting soon so that I can start putting $ into my Social security but im having trouble with coming up with proof of income seeing as I dont have a 1099, Pay stubs, or Sales Tax Return for any past year. I make more than what is required by the poverty guidelines but Im not sure how I can show for it. Since my boss is family she will try to help me in anyway to generate some sort of proof of how much I make. I dont even have a bank account, and I dont have any close family that can sponsor. Is my cause hopeless? Thank you all.

Will your relative/employer sponsor? Be careful about getting proof for the 'cash under the table', since that could get you and your employer in hot water for not paying taxes.

Proof of what you make, from your employer, is not enough.

For instance, let's say you made $25,000.00 in 2009, paid no taxes and did not file a tax return.

For the Affidavit of support, you now want to enter $25,000.00 in the income area for 2009. This is where you will have a problem.

To enter that number you either have to have a tax return, with slips, ( or a tax transcript) to back up that figure OR you have to write a short statement explaining why you did not file. You have to have a good reason - not just that you didn't want to - something like, you made under the cut off amount for filing in that year (which probably does not apply to you as the cutoff is generally very low - for instance in 2009, Married filing separately, the cut off is $18,700.00.)

Check out the instructions for the 1040 (page 9) to view the cut off amounts I am talking about.

I think im going to have to ask if she herself can sponsor then. If she is the only sponsor, I would mark the "i am the only joint sponsor" box? b/c she isn't the petitioner I am, and is that even possible to exclude me from the form, or do I need to fill one out, even though I have no proof of income. Thank you again means a lot this is all really overwhelming and confusing, which im sure you understand : )

Both you and the sponsor would need to fill out an I-864. I know it is very confusing and overwhelming, deep breaths and patience has gotten me through it so far. OK, so the patience is a lie, but still! :blush:
