Timeline

Hello everyone! ;o)

I am Canadian who applied for K-1 visa through Nebraska Service Center in March 31 2005... It's Feb. 16 2006 and I still didn't get any reply yet, besides the fact that USCIS is checking my background through FBI...

Does anyone know how much longer am I gonna wait for the papers? Did anyone else wait soooooo long through Nebraska??????

I'm loosing my mind, patience but still trying to stay positive...

That does seem excessive. Where did you get this information? Why do you say that you're being "investigated"?

Can you give more information. Have you received any correspondence from the USCIS and if so what does it say? How long ago did you get the information, and via what source?

Did you receive a receipt NOA? How did you pay for the petition? If by check did the check clear? Some times you can see the receipt number on the back of the check. I would guess it started with a LIN if you filed with NSC.

Almost 12 months does seem excessive. But by your limited details it is difficult to give you any advice. For starters though the petition could very well be stalled (sitting on a shelf somewhere) or still could be in security checks for whatever reason. Have a read of the link in my signature re Alien Security Checks. Its a long read but worth it and you may be able to find something that will give you a heads up as to what may be going on with your petition. Other then that, contact your congressman and see if they can find something out for you. All the best and I hope you get a resolution to this soon.

Latest steps:

10/26/2006- Consulate receives case (seriously, one month to receive the case?? BS!), and packet 3 that I sent even before they had received the case.

01/02/2007- Interview!!!!!!!!!!!!! Got a 221(g)

01/23/2007- Second Interview. VISA granted!!!

01/29/2007- VISA arrived.... no envelope though. I'm gonna contact them and see what happened this time!

01/31/2007- I'll have to send them one last financial support evidence.

02/01/2007- Evidence sent

02/02/2007- Evidence received by Consulate

02/06/2007- Consulate sends envelope!

02/07/2007- Envelope received!!!

02/10/2007- Flew to the USA!!!!!!

04/17/2007- Wedding day!!!

We were in almost the exact same boat. CanAmerican, Nebraska service center, and our NOA1 went through on April 11th, 2005. I received an email of NOA2 approval on Janurary 11th, 2006.

My biggest recomendation is to get in touch with your congressman's office. I did, about...mid december I think. The woman who handled it was amazing. She told us what was going on just days after getting in touch with her, gave us a lot of updates, and I'm guessing the nagging for updates by the people there may have been what got the wheels back in motion.

Aside from advice though, I wanted to offer condolences on the wait. We haven't been waiting as long, but we came pretty close, and I'm never going to forget how much it sucked. The only thing worse than the wait, is being so unsure of what's going on. Worry that the case fell through a crack on somes desk, or had just been forgotten as you see people from the same area getting through in a third, then a fourth, etc, of the time you've been waiting. Even if the congressman can't move it faster, they can at least take that worry factor away. Or at least ours was able to....good luck!

question #1: how do I or my fiance get in touch with the congressman? is it done in the US???

I'm so clueless

question #2: what does one do if it takes soooooooooo long and the possibility is that all the paperwork is lost???

the story is like this: we applied for the k1 visa and got NOA1 in March31, 2005

we're doing all the paperwork through an attorney who send a letter of 'what's going on with the visa' to USCIS - we got the reply from USCIS that they're doing a background check but the FBI is doing the check not USCIS - that was some time in Oct. 2005

the attorney send another letter to USCIS and there's still no reply...

I read one post here long time ago, some ppl were waiting 13 months from the Nebraska...

the attorney is saying that the paperwork COULD be lost and USCIS is giving the FBI check as an excuse....

man, my fiance just went back to Chicago after staying in Toronto for couple of days... I just want this thing to be over.........!

You need to take control of this situation, it will not fix itself. We can help you here, but only by giving you advice. I just found all this information in 30 seconds on the internet or this site.

Not wanting to sound nasty, but this is YOUR life and you need to start pushing the issue with people or it won't get fixed.

I wish you all the luck with this - it sounds like something is going on with your case, but only you can find out what it is. I'm thinking that lawyers are mostly useless. Most of us have done this on our own and have been quite successful.

You could also file a Freedom of Information Act (FOIA) request at the USCIS for copies of your application. This could take a couple of months, but under FOIA rules, the government must produce the documentation that you request. That way, you would know whether your application was lost or not.

02-21-2006 Mailed K-1 application to Nebraska.

02-23-2006 USPS online confirmation of delivery.

02-24-2006 NOA1 (received 03-02-2006).

02-28-2006 Touched - first time.

03-01-2006 Check cashed.

05-03-2006 NOA2 - 68 days from NOA1.

05-16-2006 NVC received application.

06-27-2006 NOA2 again?

08-08-2006 Interview at Kiev embassy.

08-09-2006 Received the K-1 visa.

10-07-2006 Arrived at JFK airport.

10-26-2006 Applied for Social Security card.

12-29-2006 Married!!!

01-03-2007 Received Social Security card.

01-22-2007 Mailed I-485, I 765, and I-131 forms.

01-26-2007 NOA for I-485, I-765, and I-131.

01-27-2007 Received Illinois state ID card and driver's permit.

02-15-2007 Biometrics appointment.

02-28-2007 Received driver's license.

03-08-2007 I-485 approved.

03-15-2007 Received Permanent Resident Card.

03-15-2007 Applied for Social Security Card with married last name.
