Hi,

I’m quite confused, recently (2 weeks ago) just received DS-3032 sent an email and NVC confirmed that they have received. Just today I have received my IV application processing fee bill invoice and will pay (online) this within the week.

Info below:

Country: Philippines

Status:F2B

Petitioner: Mom (LPR when petition was filed and now USC… as per US embassy Manila bulletin For F2B applicants (unmarried son/daughter of a permanent resident), their F2B petitions are automatically converted to the F1 category retaining the original priority date when their petitioners naturalize. Because of unique circumstances, the waiting period for the F1 category is longer than the F2B category in the Philippines.

Petitioner filled: Feb 2003

• I saw on the visa bulletin for June 2010 F2B for Philippines is 08MAR99 is this my priority date?

• Also saw the processing time for USCIS CSC is at July 02, 2003, is this my priority date?

• I read in the information about DS-3032 that when there is an immediate visa available or likely to be available within the next nine months, NVC will send a letter enclosing the choice of agent and address form (DS-3032).

o If this is the case, if my priority date is Feb 2003 and the current priority date is Mar 99 why did I received (DS-3032)?

FYI.

My Petitioner already sends back AOS Bill payment, receives I-864 now assembling.

What is my time frame to reach interview?

if your mom filed for you in Feb 2003, then that's your priority date. now your mom shouldn't have paid that, since your priority date isn't current.

the NVC was wrong to send the paperwork and your mom should have called to advise that you shouldn't be recieving the paperwork. YOu are no longer an F2B, but in the first category. children over 21 of a USC.

They are working on March, 95, so you have 7 or more years of waiting. That's wasted money because if you go to your interview, the officer will deny you based on that your priority date isn't current.

hi, u are covered by cspa act same as mine. the one who replied is wrong. because u are covered by cspa. but the question is, did you wrote an opt out letter to nvc for opr out naturalization of your mother.

i think many get married under our visa category thats why they contacted us early. im in f2b too. feb 2002 pd. they contacted me already for iv fee. dont get confused keep crossing fingers in a year we will be in states.

see the trend in bulletin, in amonth it went 5 months up..so maybe next month it will drastically move due to change in status of many applicants.

Thanks for your comment. i feel the same way...i have check the PD bulletin trend and you are correct there was a big jump in Pd's. Likewise i think that they are sending DS3032 early to determine applicants with active status, meaning applicants with no response after 1 year will be deleted and processing will advance a bit faster.

IV Fee bill : Paid

Im now waiting for DS230, my petitioner will submit I-864 within the week.

lets cross our fingers hoping that PD movement for next months bulletin (July 2010) will be moving same as last month....

I think you missed out the part that you still needs to write a request exemption to US embassy.

This info was extracted to Us embassy manila website.

For F2B applicants (unmarried son/daughter of a permanent resident), their F2B petitions are automatically converted to the F1 category retaining the original priority date when their petitioners naturalize. Because of unique circumstances, the waiting period for the F1 category is longer than the F2B category in the Philippines. However, under Section 6 of the Child Status Protection Act (CSPA), the applicant (not the petitioner) can request exemption from the automatic conversion of the visa category from F2B to F1 by submitting to the Department of Homeland Security/U.S. Citizenship and Immigration Services (DHS/USCIS) a written statement that he/she elects to have such conversion revoked. The applicant may send the written request for retention of his/her F2B category to the DHS/USCIS office in Manila by fax at 301-2208 (Attn: Field Office Director) or by mail: DHS/USCIS, U.S. Embassy, 1201 Roxas Blvd., Ermita, Metro Manila 0930.

yeah, i did that last year when my mom naturalize... i send an opt out letter since my mom is a citizen already i prefer to stay in category f2b (im f2a before and age out for the record hehehe) so i said i wanna retain my case to f2b than move to f1...

they send me letter, asking documents including certificate of singleness from nso...certification that you didnt get married cuz f2b is unmarried children of LPR

so after those documents was ent they send me letter it was approved, i retained to f2b.

then after a year april 2010 i received ds 3032 letter. im waiting for the iv bill, my mom will settle soon.

hope u didnt get married, if you do, u will be in f1 category. u lose cspa procetion.

Got it! Thanks for this information, however i am not covered in CSPA because when I-130 was filled I'm over 21 yrs of age. I think you are covered for CSPA if your under 21 when I-130 was filled.

FYI: IV Fee $400

After mom pay's this you'll receive an email with invoice number, after which you can check the status if its posted as paid. Then you can now print the document cover sheet (DCS). DCS will be used in sending your DS230 (Application for Immigrant Visa and Alien Registration) you can download this document here: http://travel.state.gov/visa/forms/forms_1342.html

Hello, may I know what is your priority date? I applied for an opt out last June to be retained under the F2B and was approved last July. My priority date which is March 8, 1999 is already current, but I have not received any instructions from the NVC. Thanks..

My PD is March 7, 2003 and already received DS-3032 (choice of agent).

I also know someone whose priority date is 2001 but received a letter from the NVC to pay and submit for the AOS AND submit for the DS-230. I am also confused why is that the NVC is sending too early packets for whose PD is almost like 6 months or let say years before for some cases to be current. Like mine, I also applied for F2B under CSPA and was approved and right now my case is now current which is March 8, 1999, but still I dont hear anything from the NVC. I emailed them like thrice time and on the first time they replied they said to submit the AOS and then the DS230. But then the second and third time, they said that my case is still under review. Bakit kaya.. NAKAKALITO..
