Hi, I'm new here but have been reading for awhile now. My husband and i are completely devastated and don't understand why.

To help you all understand alittle of what happened.............

We had our interview (hubby is the non USC), had all the required documents, lots of evidence (you name it, we had it), medical & police report-perfect. We were feeling somewhat confident, very nervous but confident. We have not seen eachother in well over a year so we were excited about finally getting a interview. Ok, so the interview went well, (at first) then the CO says that your wife doesn't make enough income, (we were given the 221g form) well we knew that so we had a joint sponsor, it was my niece. She's not wealthy and rich but she made alittle over $23,000 (no dependents). What my husband and i don't understand is, how do they come to the conclusion that she also doesn't make enough? Do they count the two of them on her affidavit of support? or am i and our children (3) counted together with my niece, and my hubby as well on that same affidavit? We are simply confused and heart broken. My husband and i discussed this and i was under the impression that the joint sponsor would be counted on there and the joint sponsors dependents (if any, in our case she had none) and the beneficiary (my husband). I don't know anymore, we don't know how this works i guess. We were given a date months from now to get another joint sponsor......I'm almost drowned in my own tears.

I kindly ask if anyone can shed some light for us to help us better understand, we both would appreciate it.

pls what does it mean when the CO gives u a temporal refusal forms to come again with the information he wants and my new dates is in the afternoon . what does it mean when u are given 212g white sheet with an interview dates and this time its being in the afternoon ? is ist likely i would be isssud if i give them what they need ?

All 221g interviews are held in the afternoon. That's kinda how the office organizes everyone coming through their doors.

As far as the Affidavit of support, I was under the impression that the cosponsor only has to support herself, her dependents and the immigrant. That would mean she has to support two people. I don't remember the income requirments anymore, but it looks like she is right on the border of acceptable where the officer has the ability to be decide whether he wants to accept her or not. Also, if she hasn't been working consistently for the past three years, then they might not accept her.

All I can suggest is to try to find a new sponsor. If you bring the paperwork on the interview date that they set you should be fine.

I agree with Kanyiri, Try to find a new co-sponsor quick. Because looking at things your nieces' income may be under that 125% after you, your fiancee and the children are added. Good luck. Also please fill out you timeline.

Hi Cabbagepatch. Don't be too dissapointed, most of us have gotteh a 221g at one point or another.

According to the instructions for I864 poverty guidelines for 2006, you or your co-sponser must be above 125 percent of the guideline. For a household size of 2 the amount is $16,500.00, unless you live in Alaska or Hawaii. http://www.uscis.gov/graphics/formsfee/for...iles/I-864p.pdf In the case that your co-sponser makes 23000 and has no dependants, she is well above this level. Did she send in a copy of her tax returns for the last three years? Although these are the instructions, the final say really goes to the consulate. They deny people for any reason sometimes. It may be a good idea as others have suggested to seek out another co-sponser that is even further above the poverty guidelines.

A temporary refusal is common, don't worry too much about that. Just try to be organized with everything they requested.

To answer this question, the co-sponsor has to be able to meet the 125% poverty level including the co-sponsor and who he or she is sponsoring.The people needing sponsorship would have to be included so if the USC and the beneficiary are the only ones, the cosponsor without no dependents would have to cover himself/herself along with the USC and beneficiary so in this case, you would have to look at the 125% Level under 3 people. SO basically, she needs the income to cover 3 people. Assuming this is clear.

My question is this. What about her three dependants. Are they counted also towards the minimum proverty level?

I Thought the co-sponsor has no dependents.

OK, I was wondering if they were thinking the cosponsor need to have the income for 6 total people.

I guess the solution would be to get another sponsor....Is it true the cosponsor does not have to be a family member? If that's the case maybe a close friend would consider helping out as a cosponsor...Just a thought.

To make it a bit clearer, my joint sponsor doesn't have any dependents, she lives by herself. I don't know why the CO decided she didn't make enough money to sponsor my husband, since it was just the 2 of them on the affidavit, but that was his decision i guess and now we must comply and get another joint sponsor. All of this is just so much, but i love my husband immensely and will do what i can to bring him home to me and his children.

Somebody correct me if this is incorrect.

I don't think the co-sponser has to proove they can support the USC (unless the USC is a member of her household and financially dependant on the co-sponser). The AOS is only for them to show that they can support those immigrating along with their own household.
