We had stroke interview 2 months ago for my adjustment based on my marriage to us cetizen husband and just this morning a homeland security came to my husband work and ask him about our marriage the immigration field afficer is telling him the our marriage is a fraud and asked him to confess that we have sham marriage if not we will face serious legal consequences. Is it normal for the USCIS to do that? What's going to happen with us now we are freakin out now, swear to god our marriage is bonified and very real.

Is that the usual process? its depressing help.

it is if they don't believe you. I would hire a lawyer fast, as this could all go very bad without legal advice.

Is that your first interview or 2nd interview? Did u guys had alot of mistakes in stoke interview?

where is your local office where the stoke interview held?

Did you submitted all the proof of bonafide marriage? How long uve been married?

As others have stated consulting an immigration attorney experienced with Stokes interviews may be a good thing in your situation.

We had a lot of mistake in our first interview and so We had our 2nd interview two months ago with our immigration attorney.We and our immigration attorney think that

the 2nd interview went well,( our attorney mention to us that time that we should prepare coz sometimes homeland security will visit us to investigate)

the adjucator said she need's a couple of months to review our case. and as i said yesterday someone

from homeland security came to my husband work. Asking him bunch of question and asking him

to confess that our marriage is a fraud and saying they know

we are a fraud, he should withdraw the petition or sign a documents saying this is

a fraud marriage,withdraw the affidavit of support, That he could be in jail for marriage fraud. Is this the normal process

if the uscis dont believe we have a bonafied marriage? or if our case is under the uscis fraud investigation?

The only advice I can really give is to see a lawyer ASAP and to not sign ANYTHING the USCIS asks you too without first asking a lawyer.

What Visa did the immigrant come in on? What country is the immigrant from? Please update your timeline so we can better advise you (in case you have questions later as well). The timeline function is up the top called "immigration timelines".

It's hard to know what to advise (for later posts etc) if we don't know specifics like how long the immigrants been here and what visa they came over on. Did you fulfil the terms of the visa? What sort of red flags do they think they found? How many questions did you get wrong in the Stokes interview? Did they send you any notifications since the interview?

I've personally never heard of them going to WORK but I have heard of them stopping by your house to see if there are signs of living together.

From what you've mentioned it sounds as if the investigation is taking place and the workplace visit was a part of the process. What is your attorney's feedback about the workplace visit?

I would think that if they are doing this kind of investigation, then they truly have some cause to believe that there may be a sham marriage. You seem to not understand what is going on and that may be part of the problem. I wonder if your attorney is doing a good job of preparing you? You did mention that they may visit and they have; I would have hoped that you and he were prepared for this and provided all the needed information and that "it went well".

First of all your husband should NOT sign any documents without consulting an attorney.

For some reason, I feel you failed your Stokes Interview despite what your lawyer said, otherwise they wont come banging on the doors. You should have compared the answers with your husband to check how many questions you got wrong. Even if you had even borderline passed the 2nd interview, they might even call you for a 3rd Stokes interview.

I dont think there this is a problem of lack of evidence of bonafide marriage or any red flags. They probably made serious mistakes on the first interview which led to the Stokes and now to this.
