Hi im a U.S. citizen who is in love with an Australian citizen. Im trying to figure out the easiest and most cost effective way to get him here permanently. He was here on the VWP about 2 months ago, and I had planned for him to come in on a B-2 visa, we get married and then adjust his status using the I-485. Is that possible? I dont want to commit a crime, and i have done a lot of research and even the information for the form itself is confusing. We have been traveling back and forth for 2 years and enough is enough. We both have made the decision that there is more opportunity in america, rather than in Australia, so he is definitely moving here, I just dont know the best way. So basically Im asking if someone comes in on a non immigrant visa can they adjust there status so that they could stay in America? and if not can he come here on a non immigrant visa, then we get married, and then petition for my resident relative? If i petition for him to come here while he is in the county, does he have to go back? Also is it possible for him to stay with me in my country while everything is being decided, even if he outstays his 6 month b-2 visa. Another thing is if i file an extension for the b-2 visa, would that be a good idea so he could stay longer? I am so confused and I would appreciate any help given. Thank you so much.

Do the k1, I believe they wont let you do 2 kinds of visas at the same time, k1 is less confusing, put the petition in, show proof, wait for approval + interview, then he comes over, gets married, then AOS. Ours took about 7 months total including 1 month of AP. So its too bad.

Do the k1, I believe they wont let you do 2 kinds of visas at the same time, k1 is less confusing, put the petition in, show proof, wait for approval + interview, then he comes over, gets married, then AOS. Ours took about 7 months total including 1 month of AP. So its too bad.

Given you have expressed your desire to marry and immigrate on this forum, then no you can not use the B2 or VWP to immigrate. Check the guides for the appropriate visa, such as K1 or CR1 visas.

So there is a way for him to stay in America while i file the petition, then he flys home to get the K-1 visa? and then comes right back so we can be married, and then file for the adjustment of status. Just want to make sure I am correct. thank you all

It won't be quite that smooth, but yes. He'll need to be back to get the visa packet from the embassy and for the interview.
