The beneficiary is my brother who is being petitioned under class F2B. He is unmarried and over 21 but his daughters' birth certificate have a false date of marriage which was done so that his daughters can have his lastname (old philippine law). He is in the process of getting the birth certificate corrected by acquiring cenomar from the reported place of marriage and then submitting that to the local registry that can then send the corrections to the NSO. He was told that this process can take sometime and my question is will it be okay to send ds-230 even if there is a date of marriage on his daughters birth certificate. Will sending cenomar with ds-230 be enough for now to avoid any issues with NVC.

I had read from several article by several lawyers including atty Gurfinkel that this is not an issue as long as the beneficiary is truly unmarried and that there are ways to repair the damage but nobody has offered any advice on how to. I guess you need consultation :-) for them to give you any answers. So for those of you who had gone through a similar case your advice is pretty much appreciated.

That will be okay... the embassy will check it out anyway...

What you need to do is

1. Get the latest cenomar from census

2. Get a certificate of marriage(will come up not married) from the local civil registrar where you are supposedly married?

3. A notarized letter of explanation of what happened... never mentioned about false ceremony by a brgy captain or anything.. indicate that was just a mistake.

4. Never attempt to fix that legally, it will cost you time and money. Embassy is already aware of this.

I understand because i've been in that same situation before, I've had this feeling that the embassy might deny my visa. I've been asked to pay 45K from the local registrar just to correct the entry and some court hearing etc that will take 4months or so... But then again, even if you just submitted the bc without correcting it, the embassy will do the dirty work of checking it out themselves if you are truly single. Tell your brother not to worry, everything will be fine. I just felt bad that you shelled out money for this... Good Luck.

Would you mind sharing you experience during the interview, like questions asked and documents that my brother would need to bring that has not already been submitted to NVC. Does he need to bring a copy of the 'Affidavit of Support', photos with my dad, latest photo my dad etc. etc. He had submitted everything that NVC had asked for but I wanted to make sure were not missing anything here. Your response will be greatly appreciated.

The interview was pretty quick and basic, about 4-5 questions.. i.e. (have you ever been married, who is the petitioner and how are you related, birthdate, what is the work of petitioner and that's it) 'affidavit of support is very important' you have to bring this or copies of records you have submitted to the nvc coz there were instances when some documents went missing during the interview that they'll ask you for a copy. And of course you have to know what your petitioner is doing for a job, how old is he, date of birth and that's pretty it... if you have nothing hide.. then, you have nothing to worry about... Goodluck.

Their original interview was scheduled way back in September but got delayed because they required my brother to do the sputum test and culture. So I'm here trying to gather as much information as I can to make sure that the interview goes as smoothly as possible as my parents have been stressing on this ever since the medical delay and that is not good for them. Again, I appreciate your input and help.
