hello VJ's

im helping my wife to fill in the DS230 and we dont know what to put on this question...

21a. Person(s) named in 14 and 19 who will accompany you to the United States now.

21b. Person(s) named in 14 and 19 who will follow you to the United States at a later date.

on 21a? should we put me and my daughter? she's with my wife

and 21b? should we put our daughter name?

02/09/10 - send I-130

05-12-10 - got an email says Approve. !!! yehey!!!!!

05-14-10 - NOA2 Hard Copy Receive

Your I-130 was approved in 90 days from your NOA1 date

Wife DS230: 21A. Wife and Daughter's name

21B. N/A

Daughter DS230: 21A. Mother's name MOTHER (KRISTINE WREST - MOTHER)

21B. N/A

Thats what i did in my ds230 coz hubby petitioned us together. I think you know already have to file DS230 each applicant.

When you say daughter, your question depends on the status of your daughters citizenship? Does your child have US Citizenship thru CRBA? Or is she your wife's child?

When you say daughter, your question depends on the status of your daughters citizenship? Does your child have US Citizenship thru CRBA? Or is she your wife's child?

Timeline

Hullo Jay -

this 'daughter' - are you the biological father? If so - you may qualify for 'Consulate Record of Birth Abroad', as the child MAY be considered a USA Citizen.

If that is indeed the case (there is a 5 year residency requirement on this) , then no need to file I-130 for the daughter.

A 'successful' CRBA results in USA Citizenship for the child, and a US Passport. No I-130 petition required.

There is a caveat, of course - if you don't meet the residency requirements (5 years in the USA) then you'll have to follow up with the I-130 for the daughter.

What I was trying to ask you is are you the Bio Father or is the child your wife's, you did say" my daughter," a child born abroad and one of the parent is a US Citizen the child can claim Citizenship or otherwise known as (CRBA) Consular Report of Birth Abroad and a US Passport at the same time.

CRBA is not a birth certificate; it is an official record confirming that the child acquired U.S. citizenship at birth and serves as proof that citizenship.

U.S. citizen parent was physically present in the USA for periods totaling five years prior to the child's birth, at least two of which where after their 14th birthday.

Sorry but you don't qualify for CRBA five years as US Citizen two after age 14.
