Hullo! I recently discovered DCF about a couple weeks ago. I'm really kicking myself about this one because it seems much more practical than other spousal/fiance visas if you can qualify for it. This has got me curious, so I thought I'd ask some questions just to find out! (We've already filed for K1 but I like to know all the options etc. for those "just incase K1 doesn't work out" scenarios) My fiance is the USC currently living in the US, and I am in Canada (currently BC, though was living in Ontario until this year). My fiance has dual citizenship - American by birth, Canadian by naturalization. If we were to get married in Canada could DCF be an option for us? He has a Canadian Passport, Canadian Citizenship card, a SIN# (for working in Canada), Ontario Health Card and Ontario drivers lisense that he could use as evidence. Except he isn't living in Canada at the moment, he moved back to the US a couple years ago (Washington state, so logically we'd go file at the Vancouver Consulate). Think his full-blown citizenship in Canada would be enough to fulfill residency requirements for DCF? I know, I should just contact the Consulate and ask there, but I really wanted to know if anyone could offer me some insight - even if it's precisely what I should talk about or ask if/when I call the consulate to find out more. Thank you so much!

February 27-07---NOA1

March 15-07------Biometrics Appointment

May 09-07------AOS Interview - Approved pending new sponsor.

June 11-07-------Approved & Green Card Issued

Removal of Conditions

May 11-09--------I-751 Sent via FedEx Overnight

May 15-09--------Receipt date on I-797

June 16-09-------Change of Address Confirmed

...one giant address change/biometrics fuxxup later...

July 28-09--------Biometrics taken (walk-in)

July 29-09--------Touched :)

August 13-09---APPROVAL EMAIL!

Hiya! DCF would be the way to go as it is quicker, BUT...you do need to call the consulate to find out what their requirements are. Because he is currently living in the US, you maynot be able to do so. I do know that to do DCF, each consular office is different as far as requirements go. GOODLUCK!!!!

It might be useful for you to look a little beyond the DCF (filing itself) and on to the 2nd part of a case--the visa application.

Based on what has been so recently for Immigrant Visa application appointments in Montreal, you may still find the K-1 process to be faster in terms of moving to the US. I think Vancouver is quite quick with the K-1 appointments.

Speed to 'work authorized' is another issue for the equation--that can be a compelling reason to choose the Immigrant Visa option.

Much depends on what your reasons for wanting to do DCF are, or rather, what your overall immigration goals are.
