I have a couple of questions on filing the AOS for my fiancee. On the I765, question 16 I dont understand, its got ( ) ( ) ( ) and says to go to part 2 for instructions but I dont see a part 2. I think it might only pertain to someone with a degree or certification but I want to know what to put there or if I can just leave it blank. Second question is on the I131, it ask about travel plans etc., I was going to fill this out in case she had to return to the Philippines for any reason but she has no travel plans at this time, should I just write "none" or should I just ignore this form if my fiancee dosent plan on traveling outside the USA? 3rd question is do I send exactly $1010 for with my I485 submission or is their any other fees? 4th question is I saw where it says to send a certified copy of your marriage certificate, can I just send a photocopy of the original or what kind of certification do I need. The last question I have is with myI-864 submission, should I send more than just my last 3 years tax returns, any other advice will be greatly appreciated. Thanks!

Hi David,

1) As a K-1 holder filing for Adjustment of Status (AOS) you are eligible to file for an EAD at the same time. Your EAD packet can be filing along with your AOS packet and mailed together. You will file as category ©(9), "adjustment applicant"...Just put ©(9) on that I-765 part.

2) For I-131, we just followed the example form http://www.visajourney.com/examples/INS-Form-I-131.pdf...though it's really your decision whether or not you want to send it, I would suggest to send it coz you don't have to pay extra for this in any case she needs to travel outside US.

3) You're right, the exact amount is $1010 and no other fees

4) We sent the certified copy and not the photocopy

5) I think last 3 years of tax return is enough

2010-09-03 : Interview sched (had to resched coz we're out of town)

2010-10-18 : Interview...approved with no problem! card production ordered (YES!)

If you would fill out your Timeline and status of what you are applying for people could help you better. Those ( ) ( ) ( ) will be different for various people filing the form, depending on how they got to the US and on what basis they are filing. You are probably in the category found on page 4 of the Instructions under #7 if you are applying for work authorization along with an AOS application. There are also example forms filled out if you look in the lighter blue menu bar of this page and click "Example Forms".

On the travel document you can say "none scheduled." It's always a good idea to file for AP because it's free and things happen that you least expect.

$1010 is correct

Photocopies of documents are fine.

1 tax return is sufficient, but 3 is good too. I would send a different kind of financial proof too like a letter from employer or couple months worth of pay stubs (photocopies).

Read the Guides found on a tab on the top menu. You'll get a lot of information. Find any link that applies to you and read, read, read.

Wow that's awesome that they accept photocopy of marriage certificate...we sent photocopies of other docs except for marriage cert bcoz the guidelines says "A certified copy of your marriage certificate"...If I've known that I would keep our certified copy of marriage cert..

Wow that's awesome that they accept photocopy of marriage certificate...we sent photocopies of other docs except for marriage cert bcoz the guidelines says "A certified copy of your marriage certificate"...If I've known that I would keep our certified copy of marriage cert..

You can also get a certified copy of your marriage certificate from the county where you married...that's what we did. I refuse to part with the original! And I don't think you should. Anyway, if you get on your county's website you should be able to find how to order a certified copy. It's a photo copy with a raised stamped seal that says that they certify it's an exact copy of the original.
