Hello all,

My wife and I were recently married. I am a US citizen and she's from Germany. We are about to send the I-485 and the I-130 packet for the adjustment of status. I'm just a little confused on some of the instructions regarding the photos that need to be sent along with the AOA packet. I was looking at the instructions that this site gave regarding the AOA packet, and also reading the instructions that come with each form, but I'm still a bit confused.

K here are my questions.

1.Does my wife and I each, need to submit two passport style photos from each of us, for both the I-485 packet and the I-130 packet?

2. Or, for the I-130 packet, we each include a passport style photo from each of us? And, for the I-485, does my wife need to submit a total of 4 photos of herself, the passport style photos? I'm asking this because in the I-485 form, the I-485 form requires two photos of my wife and the I-765 (Employment Authorization form) also requires 2 photos of my wife. So what do I do? Do I submit a total of 4 photos of my wife or do I submit only 2?

You didn't specify what visa you are adjusting from but your mention of i-485 and I-130 tell me your German wife is in the US planning to AOS from a Student, Work or Tourist visa so this is the wrong place for your question. I will move it so you can get answers relevant to your situation

** moved from "Adjustment of Status (Green Card) from Family Based Visas" to "Adjustment of Status from Work, Student, & Tourist Visas" as you are adjusting from a visa other than K1, K2, K3 & K4**

Second option. In total you need 1 photo of the USC and 5 photos of the spouse (or 7 if also filing for AP).

11/03/2008 Changed status to F-1

02/14/2010 Married

03/15/2010 Filed AOS (from F-1)

05/27/2010 AOS approved, GC Issued

02/28/2012 Mailed I-751 (Removal of Conditions)

03/01/2012 I-751 received by CSC/NOA Issued

03/15/2012 Biometrics letter sent

04/12/2012 Biometrics appointment per letter

05/27/2012 GC expires

MY wife is in the USA with me. She didn't have a visa when she came her because germany is under the visa waiver program. So I believe that's where she is adjusting her status from. Adjusting it waiver from that.

You always want to provide the documents needed for each form separatly.

So if the I-130 requires 2 pictures and the I-485 requires 2, then you send a total of 2 pictures.

08.2006: Entered with a B-2 visa.

07.17.2008 AOS approved with interview. It took 367 Days!

11.08.08: Big family wedding

09.18.09-10.03.09: First trip to France with Hubby

I-751

04.19.10: Package sent to Vermont

04.21.10: Delivered in Vermont

04.22.10: NOA date

04.23.10: Check cashed

05.17.10: Received biometrics appointment letter

06.07.10: Biometrics Appointment

06.26.10: Touched

07.07.10: Card Production Ordered!

07.17.10: Card in the mail :) Done until citizenship
