TO VJ MEMBERS

I'M A MOTHER PETITIONED BY MY DAUGHTER (IR5)WHO JUST HAD MEDICAL EXAM AT SLMEC WAS TOLD BY THE MONSTERS DOCTOR SO TO SAY THAT I WILL BE DENIED OR MY CASE WILL BE DELAYED AND MIDGHT BE PUT UNDER INVESTIGATION.I'M CONFUSED SINCE MY CASE IS IR5 AND NOT A PREFERENCE CATEGORY. I NEED YOUR OPINION REGARDING MY CASE....HERE'S THE STORY.....

DURING MY MEDICAL ON THE LAST STAGE PHYSICAL EXAM BY THE DOCTOR...I WAS ASK WHAT'S YOUR NAME, BIRTHDATE ETC....YOUR AGE, I SAID 51YR OLD, DID YOU HAD YOUR MENOPAUSE I SAID YES JUST THIS YEAR. HOW MANY PREGNANCIES YOU HAD?....I SAID 5..DID YOU HAD CAESARIAN SECTION, I SAID YES , THE FIRST 4 PREGANCIES AND THE LAST WAS NORMAL DELIVERY WHICH WAS LAST 2006.THEN SHE BECAME SUSPICIOUS AS IF SHE'S AN IO AT THE USEM....grabeeeeeeeeeeeeee.......

SHE ASK ME THE DATES OF MY PREVIOUS 4 DELIVERIES ... 1983, 1985, 1987, 1989 AND THE LAST 2006...SO SHE SAID YOU HAD 4 PREVIOUS CAESARIAN AND THE LAST A NORMAL DELIVERY? I SAID YES.....SHE SAID IF YOU HAD PREVIOUS CAESARIAN ,THEN WHY NORMAL DELIVERY ON YOUR LAST? USUALLY SHE SAID, IF YOU HAD PREVIOUS CS THE REST WILL ALL BE CS...I SAID NO, BECAUSE THAT IS NOT THE CASE FOR ME,DR SAID, TELL ME THE TRUTH IS HE REALLY YOUR CHILD(reffering to 2006 born)THE EMBASSY WILL INVESTIGATE YOUR CASE OR DENY YOUR VISA APPLICATION IF YOU CLAIM TO BE THE MOTHER OF YOUR LAST CHILD AND FOUND OUT NOT TO BE YOU.SO WHY DON'T YOU TELL THE TRUTH NOW.... I SAID, I ALREADY SAID THE TRUTH .....WHAT ELSE DO YOU WANT ME TO SAY,I,M REALLY THE MOTHER ,HE'S MY CHILD...THE LADY DOCTOR SEEMS NOT REALLY CONVINCED AND SAID AGAIN YOU WERE 47 YRS OLD WHEN YOU GAVE BIRTH TO A NORMAL DELIVERY WHILE YOU HAD PREVIOUS CAESARIAN? SAID YES...THEN SHE EVEN CALLED SOMEBODY IN THE PHONE AND WAS SAYING THIS...HAD 4 CS AND THE LAST A NORMAL DELIVERY, AND I HEARD SHE SAID,SO I WILL PUT A NOTE.THEN AFTER THAT SHE HAD ME SIGNED IT.SHE AGAIN TOLD ME TO TELL THE TRUTH...THEN I TOLD HER,OK I DON'T CARE IF THEY WILL INVESTIGATE MY CASE,OR IF THE EMBASSY WILL DENY MY VISA APPLICATION AS FAR AS I KNOW,I ALREADY TOLD YOU EVERYTHING.THEN ASK ME TO LIE DOWN AND STARTED PHYSICAL EXAM........NOW MY QUESTIONS ARE......

1.DO YOU THINK THIS ISSUE WILL REALLY AFFECT MY CASE? THIS IS AN IR5 CASE (PETITION BY US CITIZEN DAUGHTER)MY LAST BORN CHILD (wether my true child or not)HAS NOTHING TO DO WITH IT ,AFTER ALL HE'S NOT INCLUDED IN THE PETITION AND NOT A DERIVATIVE.

2.DO YOU THINK THE EMBASSY WILL REALLY INVESTIGATE MY CASE REGARDING MY LAST BORN CHILD? I'M CONFUSED....DON'T YOU THINK THEY WILL BE MORE CONCERN TO PROVE MY RELATIONSHIP TO MY DAUGHTER(PETITIONER)? PLEASE HELP ME..........

Im not an expert but for me there's nothing to worry if she is really your daughter. If they ask you more proof and you have it then just give it to them. Maybe you can ask the doctor that deliver your daughter,that would be nice if your doctor can prove it that you delivered her normally even you have 4 previous CS.

They will be more concern about the truthness of her answers, if they think she is lying about anyone thing, she can be denied. It doesn't matter if the son is included or not, it will be about answering the questions truthfully.

Do you really think the embassy will go too far in wanting to know if my youngest child is really my child, even though this child is not even the petitioner and is not even included in the petition filed by my US citizen daughter? I'm really confused..Isn't it they should be more concern about the petitioner and the beneficiaries relationship? thank you....pls help me....

A VBA4C (vaginal birth after 4 c-sections) is very unusual, which is why the doctor was doubtful, but she could have been nicer about it! In the USA, it is practically unheard of, unless accidental. But, it does happen!

I doubt this issue will affect your visa as you are not bringing your daughter at this time. If at a later stage you wish to petition her, they may require a DNA test, but that isn't certain either.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I think it is about being truthful and honest in answering the question. And they really want to know too if this is really your biological child because once you arrive here in the US,you will be issued a green card and can petition for your kids. So, this is I think they want to know if your 4th child is really your child. Anbd you know, pinoy in the Philippines, especially in CFO when you have your seminar,they are rude sometimes(based on my experience) So, as long as you answered truthfully,you have nothing to worry about. Maybe when your 4th child's turn to come here, they might ask for DNA test.Don't worry too much!goodluck,you won't be denied for your visa.

Loneyparent, it seems as if there is something about this that is brothering you. So, in saying that what the post above have stated, is exactly what the Us embassy will be the most concern with. If this is not your biological child, then you need to be forth coming with the truth. I am aware that you have stated that this child is not part of the petition, but the US is concern about the moral values of an individual that they are allowing to immigrate to the US. The US immigration consider lying to be a huge red flag.

So, in saying this if you have not lied and the child in question is indeed your biological child, then there is NO need to be concern. Good luck with your interview and I hope it all work it self out.

Im not an expert but for me there's nothing to worry if she is really your daughter. If they ask you more proof and you have it then just give it to them. Maybe you can ask the doctor that deliver your daughter,that would be nice if your doctor can prove it that you delivered her normally even you have 4 previous CS.

If they are really giving you a hard time then maybe DNA testing would help answer their questions. I know it is drastic but it might come down to that.

Hi there...u have the same situation with my sister where SLEC suspecting my sister (she is in K1 & K2) that the eldest child isn't her and that she just "as if" including someone in her petition...but of course its her son and very own child!.....they suspecting her becoz of delayed registration of birth certificate which was process same month of there interview at the embassy..(she never expecting process of interview for K1 & K2 was that fast) so what she did to prove to the SLEC and US Embassy, she asked letter of affidavit from the doctor, affidavit from the attorney to prove that its her son, and of course pictures of them both when the son was day old till' grown-up....it's really works on her. They're just trying to test you i guess how truthful you are to them and besides having 4-CS is very unusual.....hope i give you some ideas what to do...Goodluck....

I'm helping my step-father (USC) petition his son (Vietnam beneficiary). Because of delayed birth certificate registration, USCIS sent an RFE for additional evidence of paternal relationship. Because of the history of Vietnam, there is a lack of available evidence available. He went forth with the DNA testing April 16th via an approved testing center. The testing in VN has been scheduled, but they're asking for $40 to conduct it in Vietnam. It's odd because the testing center said that there shouldn't be any additional fees (the testing in US costs 800!). Anyone have experience with DNA testing (preferably in Vietnam)?
