CR1 Help Please!

I plan to visit my fiance this June. Chances are we are going to get married in July. When we proceed with the CR1 Visa, can I stay in the US with him while in the process? Or, until I have to get my medical check and have my interview? Would I be able to go back and visit with no ties to Canada other than showing them the NOA? If they deny me entry, once I get my CR1 Visa, I should be able to go no problem right?

Hi

you need to wait abroad till the process is completed you can visit him but could be an issue at the POE, showing no ties to your birth country. and probably you would be rejected.

In the other hand if both are inside. married and living together you can file an aos, and stay in usa while waiting but the main problem is that is not legal to enter with the intention to apply for and AOS and could be declare as a visa fraud.

So legally talking your best choice is keep waiting abroad and wait for the Consular Process.

If you state to the officer that you have intent to marry...and will be filing for the CR-1 while your there...then chances are slim...that they will let you through...

However...if you download the I-130 form...there's a question that says...state if your spouse is in the US...what dates did he/she entered...

So does that mean...they allow people to file for CR-1...while the foreign beneficiary is with them in the US....??? something to think about...

Not sure...

I would rather get married at your hometown...get your husband to apply for the CR-1...and then you can cross the border...showing ties...

I am going to be crossing the border in July...with limited ties back home...but its a little different for me...as I am sorta almost at the end of the process...but show whatever you can...that you have a life back home...

I am going to show everything...whatever I can...let's see...

2008 July 5 -- We met!

2008 Aug 9 -- He Proposed, I said YES !!

2009 Aug 21 -- Officially got engaged in front of family!

2009 Nov 22 -- We got married`

USCIS Journey: California Service Center

2010 Jan 08 -- Filed I-130 !

2010 Jan 11 -- I-130 Delivered!

2010 Jan 14-- NOA 1

2010 Jan 20 -- Touched

2010 Apr 01-- RFE notification via text/email =( [on my birthday]

2010 Apr 15-- Touched

2010 Apr 21-- Text recieved by USCIS indicating Approval-- NOA 2 hard copy mailed out Apr 20--[unbelievable how fast they responded with the approval in 4 working days]

Your I-130 was approved in 96 days from your NOA1 date.

2010 May 01 -- AOS Fee Bill Payment Status: PAID

2010 May 05 -- I-864 form and supporting documents emailed!

2010 May 12 -- IV Fee Bill Paid

2010 May 16 -- DS-230 Form and supporting documents emailed!

2010 May 19 -- Email recvd from NVC-Case Complete- SIGN IN FAILED!!
