AOS stoke interview in our initial interview????

Hehehe, we have been married and living together for 6 years and I doubt whether my husband knows what nights are garbage night because I'm the one who puts out the garbage! I agree that those are minor questions and should definitely not go against you. If the 65 pictures you submitted were all of the same event - eg, the wedding - then I can understand the IO asking to see other photographs from before the wedding to show that you had established a relationship before the actual marriage. Your evidence looks decent for the AOS as well - and since you were able to respond to the request to provide more evidence I suspect you will probably be approved.

Q. The U.S. Citizenship and Immigration Services has called my wife and me in for a second interview.

Is this a so-called Stokes interview? What's likely to happen? Why did the USCIS tell us to bring photo I.D.s?

My wife petitioned for me, and the USCIS interviewed us last April. The interview mostly went well, but

my wife couldn't name my children from a prior relationship. A week later, we received a letter calling us

to another interview, asking us to bring the same documents we brought before.

A. If the USCIS addressed the letter to your wife, the interview will likely be a Stokes interview.

If USCIS addressed it to you, then it is likely a followup interview on your application for adjustment of status.

Based on what you write, my guess is that yours will indeed be a Stokes interview.

A Stokes interview is a taped interview in which the USCIS separates a couple and asks the husband and wife questions.

The goal is to determine whether the marriage is bona fide, or real.

The term Stokes refers to a federal court decision that forced the immigration service in New York to provide applicants

a fair review in marriage cases. It seems that the USCIS wants to make sure that your present marriage is bona fide.

If it is, you and your wife shouldn't have a problem passing.

At the Stokes interview, the examiner will interview you and your spouse separately. Typical questions are

whether you have met each other's family, your favorite foods and drinks, and how you two met.

Other typical questions involve your food and restaurant preferences, the number of TVs you have in your home

and details about your home or apartment. The examiner is supposed to avoid questions that might be embarrassing.

If you can't remember something, say so. Saying you don't remember is better than making something up.

If you and your spouse give the same answers, you'll probably pass the interview. If several answers are different,

the examiner may deny the petition your spouse filed for you.

Beyond the interview, the examiner should consider other evidence. Examples are joint tax returns, joint bank accounts

and insurance policies.

You have the right to bring an attorney or accredited representative (a government-authorized nonattorney)

with you to the interview. Try to do so.*

Regarding the EAD and I-94. During our interview, Kyle's I-94 was taken but his EAD was not. There have been quite a few other aos interview experiences posted on VJ recently that also say their EAD was not taken. As far as the photos go, I think Kathryn is correct. I only brought about 30 pictures total with us to the interview, but our IO just looked at them and said what we had sent in previously (about 12 images in a collage on a sheet of paper) was great. We had sent in images of us dating, me in scotland, him over here before, during, and after marriage. I also dated those pictures on the collage sheet.

Those questions were kind of silly, I agree. By the way, I still don't know the trash days, but my husband does as he is in charge with carrying the trash bins outside (they are too heavy for me) :lol: It's kind of confusing: one day they they pick up the trash, another day is recycle day, another day is "yard pick up day"...so of course I would always mess up the days!

It's good that you answered "I don't know" instead of making up answers that wouldn't match your spouse's answers anyway.

Do you have pictures taken before you got married?If yes, there is nothing to worry about, be optimistic!
