The issue is not for the US consulate but is a PI issue... moving to PI regional

YMMV

Since you are a foreigner in the Philippines, Yes! you are allowed to stay 21 days, however once you exceed on those days you have to pay a fee for the extension of visit. You can call "The Bureau of Immigration, Philippines" for the fee.

It sounds like you can avail of Balikbayan privilege, which is valid for 1 year. This is a FREE service for Balikbayans. It is available to "the spouse and the children of the Balikbayan who are not Balikbayan in their own right traveling with the latter to the Philippines."

The only documentation you would need to avail of this privilege is: (1) your expired Philippine passport, (2) marriage certificate, for your spouse and (3) birth certificate, for your child.

You may contact the Consulate General's office in Los Angeles to verify this information. This office has jurisdiction over Texas.

If you are the mother of the child you are OK, since you are filapina, that makes your child both filapino and USC.
