Hi Guys,

We are just starting the AOS/ EAD process and have a questions. When it comes to Eligibility category we have no idea if we are supposed to be (a)(6) or ©(9). A-6 is for K-1 nonimmigrants who apply within 90 days of entering the U.S, which is us..... but C-9 is for Adjustment of Status Applicants and that's us too because we will be filing for AOS at the same time.

Any help and past experience would be greatly appreciated!!!

What did you all file as?

7-15-07 Met in Cambridge, England while I (Meggie) was studying at Cambridge

-Love at first sight :) Visited each other COUNTLESS times between August 07- July 08

-Meggie moved back to UK on work program. Continued relationship July '08-January '09

-Kevin's visit to AZ for our birthdays 2009 (March 9- Kevin & March 10- Meggie)

3-10-09 Engaged!

3-28-09 Filed the I-129F Petition at California Service Center

3-31-09 NOA 1

4-2-09 Touched

4-3-09- NOA 1 Received in mail!

6-2-09 thru 6-7-09 Kevin and Meggie meet in Minnesota for a family wedding :)

8-28-09 thru 9-7-09 Kevin visits Me in Arizona

9-9-09 Congressman's office sends inquiry to CSC on our behalf.

9-10-09 Touch!!!!!!!!!!

9-11-09 Recieved email stating approval notice sent- approved 9/10/09!!

The answer is C9.

The reason for the K1 category is because you can file (and pay for at a nice price of $300+) an EAD prior to filing for AOS and if you do that, you would file as a K1 (not AOS) a6 category.

The reason you shouldn't even waste your time (and money) paying for an EAD before filing is because it's only valid until your I-94 expires. It takes MAYBE 2 months to arrive which means you have 1 month to use it which just seems an awful waste of money to me.

So anyway, there you go. Also, example forms up the top should help you too. There is a sample EAD which is filled in how you need.
