I'm french Canadian and moved in the US last August 2009 with a tourist/pleasure visa classified B2 which was good for 6 month ending in February 2010. I got married in January in the US, so now I'm about to fill form I-130 and I-485, knowing that exceeded my allowed time to stay in here.

My question is; will I have to go back to Canada before I can get approved for my permanent visa in the US ?

Moving this topic to AOS from tourist, student and work visa.

OP, do not leave the country until you're done with AOS process - you will receive your permanent resident card (not a visa) in the US. Follow the guides.

Hi and welcome,

You are filing for an adjustment of status, therefore you cannot leave the U.S. until you get advance parole or your green card, whichever comes first.

Before starting to fill out any forms, take a look at the guides here for adjustment of status. The link to the guides is at the top of this page, you will want to read the one entitled I-130 Petition and Adjustment of Status Guide.

Good luck.
