My wires mother recently received her 10 year tourist visa? I was under the impressionthat 90 days is the longest she can stay per year, but when filling out the application it asked how long she intends to stay. Are there exceptions to this 3 month rule?

Timeline:

03/03/2009 - Arrival in the US!

05/03/2009 - Married!

05/28/2009 - Filed I-130, I-485, I-765!

06/04/2009 - Checks cleared!

06/08/2009 - I-765/I-130 NOA Received!

06/10/2009 - I-485 NOA Received!

06/11/2009 - Biometrics appointment letter, scheduled 06/23/2009

06/17/2009 - I-765/I-130 Touched!

06/19/2009 - Attempted early biometrics... they said nope!

06/23/2009 - Biometrics completed.

07/07/2009 - EAD card production ordered.

07/13/2009 - EAD card production ordered, again.

07/14/2009 - I-765 - Approval notice sent.

07/15/2009 - EAD card received!

07/20/2009 - SS Card applied for.

08/05/2009 - Received Interview letter - Scheduled 9/14!

09/14/2009 - Rescheduled because we moved to Dallas

10/14/2009 - Interview - approved!

10/23/2009 - GC Received.

The visa waiver program is 90 days; the tourist visa usually allows 6 months, but it is up to the border agents when the tourist arrives, they can stamp the passport for less than 6 months.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

yup - it's up to the folk at CBP, each time, on each entry. could be up to 180 days - but could be much less, as well.

a human will look at yer mother and make a decision, at the POE.

The maximum time in one visit is 6 months (ofcourse depending on how long her I-94 says). My mother has visited me 3 times and all times her I-94 said 6 months. Infact, the 1st time she came here was when I was pregnant and hubby was deployed so she stayed 6 months, went back and came back again in a week coz my baby got sick, she was allowed another 6 months but she only stayed for 2 months. both my parents visited us in january 2010 and went back in april but they were allowed 6 months on the I-94s.
