Hello everyone.

I am trying to figure out what I should have my wife do regarding her passport. Currently she has her maiden name on her passport and all the documents that we have submitted are with her maiden name. Should I have her change the name on her passport while she is overseas? Or should i let it be for now and once she comes to US change it here.

I prefer not to change anything until she comes to US but i would like to know if there are any consequences of doing this.

Please help.

I am trying to figure out what I should have my wife do regarding her passport. I think that you may want to wait until she is in the US. I would be a little concerned that the name change will cause issues until she is in the US.

I am wondering if you can help me on this issue. I submitted my I-130 with all the supporting document required and some. I also changed my name to my husband's family name in February, 2010. WOW, what obstacles that I am facing!

Fist, the IRS has my tax return pending for over 8 weeks because of my name change even though I filed after the SS administration updated name change prior to me filing my taxes. I never received anything in writing from the IRS. I checked online. I requested a referral, but who knows how long that will take? I am early in the process, but I worry that I may not get my 2009 transcripts, because of this issue, when I need it for my affidavit of support. Not sure what to do.

Secondly, I received my NOA1 yesterday and they have my last name with my maiden name hyphenated and married name. On the I-130, I put my family name, but I included, in parenthesis, my married name. Should I have that corrected? All my ID's including SS card, driver's license, and passport only has my married name, not maiden name. If I request that to be corrected I know we are looking at an additional 30 day delay on top of the normal processing time. Should I let it go and let USCIS request a RFE if they deem it as an issue or not?

My husband wants me to fix it, but he is not familiar with how fast things can go wrong. I am not sure either.

I am not sure what to do. I guess you will have to sort it out with the IRS as soon as possible. From what I can tell, IRS shouldn't have any issue with the change in name if you have the proper application filled out and submitted. You should call them and try to see if you can setup an appointment with them or resend the application for the name change.

I wouldn't change my wife's name because it would only create more hassle of keeping up with proof, paperwork, etc. Just leave the name as it is now. If you really want to change it (though I dont know why an Indian has to do that) you can do it once she's here.

By the way, I thought in India, wife keeps her family name and doesn't have to change it into her husband's name. Is changing name a farely new thing nowadays?

No in indian culture wife takes on husbands family name. Not sure if everyone does it or not but that's been the culture for ages.

If you really look at the fact changing her name in the passport now, will be another proof of bonafide marriage...!!!!..give me your thoughts on this...!!!
