HOA Forcloses On Home For Not Paying Fees Eventhough The House Was Fully Paid For.

It is why I hate HOAs... The idea of paying for something absurd and then if you don't, they take your home? It's ridiculous.

It is what it is and why I won't take any part in one.

No it's not. You don't hate the fact that the HOA foreclosed on a house that was fully paid for because she didn't pay her dues, you hate the fact that HOA's make you pay for services you don't think you need in the first place. That is not at all the same thing.

No, see posting on a message board isn't really necessarily 'interacting' with people. You don't have to be annoyed by their breathing, you don't have to be annoyed by their mannerisms, etc.

There's no 'expectations' here as far as saying something or not saying something. You can ignore a person's post or not. You can close a window and be done with it in a second.

If you say so ;)

nope. always a part of the original contract you sign when you buy your home.

It's why I'll never move into a neighborhood where some association can dictate what the hell i do on my property and charge me a fee to do so.

No, actually it's not.

oh ok, so you're going to tell me how I think/what I like/don't like.....

I do hate the fact it did what it did, because I think the idea is completely absurd in the first place.

If you can't see that, then it's not my problem.

The problem with you, is you fail to see the difference in 'recognizing' something as not being for you, and something just being plain wrong.

I think it was wrong and it sucked that the HOA took her house. I do however recognize her wrong doing in no paying and recognize that she signed a contract that allowed them to do so. - I think this is wrong that a fully paid for house can be taken by a third-party and I don't like the idea of it at all. I still recognize the ability to do so though.

No, actually it's not.

should have said "buying process" as it is a contract/agreement you have to sign in order to buy that house in that neighborhood.

It's not part of the actual mortgage contract.

Too funny. What you are saying doesn't make sense. You either hate the fact that they took draconian action against a homeowner who didn't pay her fees or you do not. It's not hard to decide which side of the fence you are on. All this, I hate it only because HOA's have the right to make their own rules that I don't want to play by because I hate people ####### is just that, illogical senseless #######.

Madame Cleo, why are you jumping all over Paul's sh!t here? Unless a post has been deleted, I dont know why you're getting so worked up and twisting his words.

Guess what? I don't care what you think and I don't intend to give you an answer.

Wow I never knew they had the power to take the house like that. Sure its a contractual requirement, but I always figured that the route for recovery would be a lien or lawsuit.

You said, it's always part.

I said no, and I should have been more clear...every single HOA does not have the power to foreclose on a property, and it's not automatic as you suggest.

Well yeah. Laws will vary from state to state, and also depending on the land owners agreements at times with the HOAs.

Also I mean this wasn't just an instant foreclosure either. Took 4 years to take place. - I think it's NUTS what they sold her house for as well.....

The $150,000 property was sold to a company in Dallas for just over $3,100 — that's the $1,200 Mueller owes plus legal fees.

She has until July 6 to match the price or be evicted, but Mueller is still unemployed and says she is still financially devastated.

They sold the house for $3100? #######?

I don't get why she didn't pay the fees in the first place, $1,200 isn't very much, or why she can't borrow $3100 that seems to be the amount required to put her back where she started and no longer owing the fees. It's all very odd.

I am sure it is a lot to some.

If her house was paid off, you'd think she could get a HELOC and be done with it. Or, if she's old enough, a reverse mortgage.

If I were a member of that HOA, i'd be pissed at the board for selling a house worth $150k for $3100. They could have sold it and written off everyone elses HOA fees for years with that money.

It's not that much when you consider what it means to not pay it - it's not like it's a sum that you couldn't borrow even if the interest rate was a bit wacked because you are on a low income.

Reverse mortgages are hilarious. I guess they make sense for some, but in the case of my great aunt, they basically said, "Here's $500,000 now, and we expect you to die in 8 years at the age of 84". She is now 97, in perfect health, and laughing at the bank

UPDATE:

http://www.wfaa.com/news/local/Burleson-womans-HOA-crisis-resonates-with-WFAA-viewers-93744684.html

BURLESON — Sherre Mueller admits it was her mistake; her battle.

But thanks to the generosity of News 8 viewers, the Burleson woman is on the verge of getting back the house that her homeowners' association sold.

Now her focus isn't on foreclosure — she's looking toward the future.

The response to her story that was first broadcast Wednesday night was overwhelming. "Oh my goodness, this is unbelievable!" she exclaimed.

Mueller spent Thursday returning calls and responding to dozens of supportive e-mail messages.

Mueller home was foreclosed on earlier this year because she fell behind on her HOA dues. She has only a few more weeks to scrape together enough money to get it back.

Her story seemed to touch many who saw it. "These are all strangers," she said. "They don't know me; don't know anything about me; and they want to help me."

Mueller's husband died in 2005. She used the insurance money from his death to purchase their $150,000 home outright.

Being unemployed, she sold her jewelry to help pay bills, but let her $300 annual HOA dues go unpaid for four years.

Now, many people are offering to pay the $3,200 it will take to get her home back.

But even simple words of kindness and compassion have gone a long way to help a woman who had already lost so much.

"I can't even explain what it's done for my life," Mueller said. "I can't explain how it's turned my life around and made me love people more than I ever have in my life."

The attorney for the Mistletoe Hills HOA told News 8 he's happy Mueller is getting the help she needs to get her home back. He also said he hopes she will be able to pay her HOA fees in the future so something like this never happens again.
