Please answer another question seems i have so many

doesn't it

what is the time frame of filling out the i134..

lets say i fill and send it to fiance then we dont have

interview for say 6 months is it still legal ?..

also will they want just w-2 or will they want entire

tax form....

also in 2004 i was married to 1st wife and she is on

the tax document will that make a difference.

if you can think of anything else

They say the I-134 should be as recent as possible, 'cus of it being notarized, but I guess 3 to 4 months is reasonable.

What the consulate will ask will depend on your consular officer and the consulate you're going through. Most will required the last year's tax returns.

About the former wife you can write a statement explaining the situation.

I would agree with most of that.

On the tax/EX thing, with your included divorce decree, it would be intuitive that you were eligible to file together with your ex, if you were still married more than 6 months in that particular tax year.

They say the I-134 should be as recent as possible, 'cus of it being notarized, but I guess 3 to 4 months is reasonable.

What the consulate will ask will depend on your consular officer and the consulate you're going through. Most will required the last year's tax returns.

About the former wife you can write a statement explaining the situation.

I would suggest to send the I-134 (must be notarize) 1 month before her interview along with the bank statement, employment letter, W2’s (for the past 3 years) and Income Tax Return (for the past three years) as supporting documents for the Affidavit of Support.

My fiance that time (husband now )send me the W2's and Income Tax Return (for the past 3 years).

Same with my fiance that time, his ex-wife name was on his 2 Income Tax document and no problem encountered in the US embassy.

I think you're confusing the I-134 with the I-864. The I-134 requires a copy of the last tax return filed ONLY IF the petitioner is self-employed. Even then, it's only the last return filed.

Otherwise, a tax return is not required.

Precisely! That is why i had questions on my last posting about I-134. I have searched with a microscope for tax requirement on the forms and i do not see any, however the confusion between I-134 and I-864 may, sadly, be spilling over to COs who may be asking for same things they ask for on 864.

Oh bother, i just may have to stick with my default M.O and send everything and then work for one week in Fedex to pay off the bills.

Not necessarily. Some consulates will ask for tax returns even if not required for people who are not self-employed. Also, it's about submitting all the evidence one deems necessary to "convince" the CO one's in a position they can support their fiance.

I only offer advice - not even legal. Just the plain and simple kind.

I agree Mew. The I-134 is only one thing that a conof may use to determine if the applicant will or wont become a public charge, hence why more often then not, other documention outside of what is instructed with the I-134 is often required.

Not required by the I-134, perhaps. But the consular officer processing the visa application may well ask for tax returns independent of the I-134, and they often do - sometime 1 year, sometimes 3 years. (Keep in mind that the I-134 itself is not required unless the consular officer exercises their discretion to ask for it.)

I notice that you do not have the T-shirt yet - do you plan to not provide your fiance with a tax return as part of his financial information package for his interview? Either way, please let us know if it's asked for.
