That doesn't change the fact that we are "legally" not at war. If we want to have war tribunals and all of the procedures that go with it, congress should have declared war.

Well, constitutionally speaking (and why it hasn't been challenged) the war really is 'legal' in using the appropriations process to continue the funding of the war.

Well, constitutionally speaking (and why it hasn't been challenged) the war really is 'legal' in using the appropriations process to continue the funding of the war.

The fact of the matter is none of this has ever been tested by the courts. The last bill on this was the War Powers Resolution which tries to differentiate between a "military conflict" and "total war".

Please correct me if I'm wrong, but the US has never conducted any trials against aggressors during or after the Korean conflict, Vietnam, Iraq I, Iraq II*, Kosovo* right?

*There were trials afterwards in Kosovo but were conducted on an international level. Likewise there were trials in iraq but they were conducted by the Iraq gov.

YOur point is well noted but I think it's becoming more and more clear, future wars will not be as wars have been in the past, they will be operations and campaigns.

The down side is... they are easier to get in but also easier to get out of.

It might be the Constitution needs amending to draw parameters for this sorta of modern-day reality.

YOur point is well noted but I think it's becoming more and more clear, future wars will not be as wars have been in the past, they will be operations and campaigns.

The down side is... they are easier to get in but also easier to get out of.

It might be the Constitution needs amending to draw parameters for this sorta of modern-day reality.

Korea: Technically thats 60 years and going. 1950-Present

Bay of Pigs: 1 year 1961

Vietnam: 25 Years. 1955-1975

Persian Gulf: 1 year 1990

Kosovo: 1 Year 1995,96

Afghanstan: 9 years 2001- Present

Iraq: 8 years 2001-2011?

PreWWII the longest was the revolution at 8 years.

Vietnam: 25 Years. 1955-1975

Persian Gulf: 1 year 1990

Kosovo: 1 Year 1995,96

Afghanstan: 9 years 2001- Present

Iraq: 8 years 2001-2011?

PreWWII the longest was the revolution at 8 years.

Korea: Technically thats 60 years and going. 1950-Present Yes USA still there, still an active front, complete with periodic shooting etc.

Bay of Pigs: 1 year 1961

Vietnam: 25 Years. 1955-1975 We can give Danno Logic the benefit of some doubt here, USA involved early 1960-'s to 1974 really, but some 'advisers' there in 1961 the 1950's being a French conflict

Don't forget Grenada! 1983 and over in a heart beat, but we used more force than the Normandy landings! Ron proves he doth not take $hit from anyone...

Oops typo on Iraq (the total years is correct). I used 1955 for vietnam because 1955 was the first year the US government started putting money into the situation (and actually the first US causality was in 1954), but your right an active role wasn't taken until the 1960's. Most people probably consider 1965 the true start.
