All of these measures are so widespread that they represent a shield against all possible forms of terrorism? Everything you mentioned is fairly rare and non-existent for U.S. citizens suspected in being involved in terrorism.

Compare it to ordinary crimes in this country? Have the innocent ever been convicted? Sure but that ooesn't mean we dump the entire system that came from tougher sentencing and more prisons which removed a lot of criminals from the streets and reduced crime rates for years. All this yet we've still got a high rate of crime compared to many other developed nations even when we've played by the rules for the most part.

I don't buy the notion that we are "at war", and that this justifies adopting WW2 era approaches to prosecuting terrorists via the premise that this would somehow have prevented the attempted bombing in Times Square.

We are at war by our own choice in Iraq and Afghanistan. We are not "at war" with terrorism and the entire notion of a war against ideology is ridiculous.
