I have been reading all of the posts here regarding processing times for the I-130 and K-3. There seems to be a great amount of differences. Some people say 8 months to a year and others are saying much more (or less). From reading people's time lines there is also a huge difference. Some are getting their approvals and moving to the U.S in just a matter of a few months. Does it depend on the Embassy that the person you are sponsoring comes from? My husband is British. We have gotten so much conflicting information from the USCIS and the British embassy. (and from the customs guys too).

When he was originally turned away at the border the guy that sent him told us to file the K-3, he told us he has never seen it take more than 30 days to get it) clearly a lie. From what I have read both the K-3 and I-130 take at least 5 months (just on the U.S side) and could take another 6-8 months on the British side before he can return home to me.

Why is there such a huge difference in processing times (and why do you think there is such a difference in information from one person to another in regards to USCIS) everyone keeps telling us different things.

I can only tell you from personal experience.

First of all, the K-3 is obsolete. We filed for K-3, but it turned into CR-1 once it hit the NVC stage.

Our journey has been riddled with problems since the beginning. USCIS let our case sit for 5 months, until I got my Congresswoman involved, then it was approved within 48 hours...clearly a USCIS mistake...everyone else around us was being approved within 3 months.

Case got to NVC w/no problems, however, hubby didn't order a certified copy of his divorce decree from his first marriage - that set us back a week. Then, the volcano erupted and we couldn't get the decree from the UK to the US. Everything @ customs and then everything @ NVC was backed up due to the volcano and the influx of paperwork received when planes could fly again.

But, I'm happy to say, after 7 months, we have an interview date, as of today...He should be on a plane back to me by late June...

I would say, in MOST circumstances, your journey will probably be faster than ours...I believe average is about 5 months from start to finish.

But, if you haven't filed yet...DON'T go K-3 - it's a waste of time...

So your husband is a U.K citizen too? I already filed the K-3 but I haven't gotten anything back from them other than the receipt but that was back in January. I kind of figured that one is dead in the water from what I have been reading. The processing time variances just make me crazy, I have no idea how long it will be or what we can expect because everyone's stories are so random and different. Speaking of the Volcano, I was on my way to England to visit my husband for his 40th birthday when my plane was diverted to Paris because of the eruption. It ended up taking me an additional 24 hours to get to him. Literally planes, trains and automobiles lol.

The time will go by much quicker than you think. The stage your in now is the longest. Once it hits NVC, the time flies. Now is the time to gather documents / evidence / have him get his Police Certificate and all of that fun stuff. When you hit NVC, you'll get out of there in no time.

Rest assured, It's usually faster than 8 months, usually closer to five - I don't think anyone on earth has ever received a Visa in 30 days.

You might want to ask around to find out if the denial of entry will affect the application...I don't know if there is anything extra you might need to show...
