i dont have enough evidences to show to the immigration based on thier requirments,i only have mails send to the house i lived with my ex-husband,fone bill and joint account statement and nothing else,my husband doesnt claim me on his taxes,he never gave me insurance,we never had a haus,no car,no bills except fone,no other property,..i file divorce 2months ago and i have to file the change of status for 10years alone and my 2years conditional green card will expire july 2010..i am scared and nervous now becoz the expiration date is fast approaching..can i still file for the petition without enough evidences???can i apply it by myself because i dont have money to get a lawyer....i hope i can get an advice from people here becoz i am really confuse on what to do..thanks guys...godbless..

lots of affidavits from credible 3rd parties as to the validity of your marriage. credible parties do not include family members. try your clergymen, neighbors, landlord, banker, etc.

if your husband never claimed you on taxes he was an idiot, or knew you would use a joint tax filing for validation of your marriage, and chose not to. speak to your local IRS office. he may have filed with you as a dependent for 2008 and simply not told you so. in that case, you could get a copy of the tax record from your local IRS office. all you need to know to find out is his name and SS#, and your name and SS#.

Did you file tax returns???? If yes, then you can include them to show that you filed as a married filing separately. It is still acceptable. All the evidence you mentioned is good and will help - so include as much as you can. Also, you can include a cover letter explaining that while married, you (and your husband) did not own a car, house, etc.. like you mentioned in this post.

She said the husband never claimed her on his taxes so he may have filed as single. That will be a no-no with uscis. The least worry would have been if he chose married filing separate. If he flat out ommitted her entirely, then that puts her in a bind when it comes to taxes. Maybe OP can share a bit of light on the reason for divorce. That way people who have been down that road can tell her they got out of that jam. Demestic abuse (unfortunately) can help out if that was the case.

Well - in my opinion, if the husband filed as single, then he can be accused of fraud and it is a serious problem. Unfortunately, that will not help the OP but the husband is also irresponsible for performing such actions.

This may actually help the OP in her case for filing divorce. She claims that he doesn't treat her as a wife and IRS documents can prove that he never thought of her that way... now there are two faces to the coin and she needs to show the "shiny" side to USCIS. I am not suggesting she lies or misleads them, but she needs to show the IO that her divorce claim is due to facts (such and such) and the evidence she is providing supports her claim.

Just like a person claiming that that USC spouse abused them is not enough - they need to show police reports and or other documents to support the claim.

Nevertheless, regardless of what the husband did, she was supposed to file her own taxes knowing that her husband didn't include her...
