We just got home from our weekend away in CT and RI. Looking through the document US immigration want my wifes tax returns for 2005. Also they want a letter from her employer, recent pay stubs, how much she earns. Thats ok but the bit i am very concerned about is You are ineligibale for interim employment authorization pursuant to title 8,Code of federal regularations, Section 103.2(B)(10)(ii) until ninety days after the missing evidence is received. I applied for the EAD on june 12th, didnt get a receipt number until june 26th. It was my second time applying as the first time when i applied along with my greencard it was sent back as my wife had put 2003 instead of 2006 in the cheque.

We will be getting the tax returns tomorrow as our accountant has been away on holidays for the last 2 weeks.

Does this mean i can forgot about getting my EAD in september? It has been one screw up after another and money is really tight and i need to work as soon as possible as we have bills from here and bills from ireland. US immigration really make hard dont they.

It took 41 days for this letter to arrive, not my fault. I did everything by the book and had 2 infopass meetings about this rfe.

Get together your stuff for the RFE and sent it in. If you don't get your EAD, schedule the iEAD appointment 91 days after you got your NOA1 and you may still get it. I've heard about many people still able to get their iEAD even though they got an RFE.

I have a letter from my wifes employer which we submitted originally which states how much my wife earns, the type of work she does etc.

Also i have 4 wage slips as my wife is paid bi weekly.

We will get the tax returns for 2004 and 2005 tomorrow so that should be enough to satisfy USCIS. Should that be enough.

You didn't put 2005 Tax return in with the original document?

Nope we only submited 2003 and i put a note saying why i hadnt included 2004 and 2005. My wife worked in ireland for 2 and a half years. Her 2005 returns will say she earned 60k a year while in ireland.That should be more than enough?

Definitely more than enough.

My wife got a call from our accountant today. They told her she can pick up her tax returns this evening. So we are all set to send the rfe back through express post tomorrow.

We have the tax returns, employment letter dated march 20th from when my wife got it originally from her boss. We have 3 recent pay stubs as my wife is payed bi weekly.

It only asks for the most recent tax return and an employment letter and pay stubs. That should be enough. I am only asking again as i dont want to make a mistake as the last one took 7 weeks to remedy.

Hello, galwayman. I am happy about you finally recieved RFE.

Interim EAD may be late... But dr_lha is right. Some people got interim EAD after 90days of NOA1 so you should try it.

And also, many people, such as me, recieved initial EAD after returning RFE.

I sent the rfe back today via express post.

I included tax returns for 2004 and 2005 which state my wifes earnings of over $50k for each year.

I included an employment letter, 3 wage slips and finally the last 3 months of bank statements. Hopefully this is enough and i triple checked everything. In total i sent 50 pages back to them to satisfy the rfe.
