EEA spouse in UK, when can we apply for DCF

Timeline

I realize that if I marry a UK spouse, I would be eligible for FLR in

two years, but with a spouse from the EU (living in UK), it will take me

FIVE years to gain FLR. Does this mean that I would need to wait five

years to apply for DCF to get my EEA spouse legal into the US?

Any insight would be helpful.

Hello. I guess this 'FLR' you refer to is with regard to your residency in the UK? It's difficult to understand what you are asking. What is your residency status now? What nationality is your fiance/fiancee/husband/wife? If you could provide more information it would be helpful for people to assist further.

Different embassies have different requirements on the residency of the petitioner and beneficiary. If your case is not straightforward, I would contact the London Embassy and ask if they accept DCF in your case (if this is indeed what you are asking!)

Timeline

It generally takes 2 years of legal residence in the UK to be able to file a I-130 at the USCIS office in London whether that is through an ILR or otherwise...
