(FOXNews.com) - A Texas third-grader was slapped with a week’s worth of detention for possessing a contraband substance, FOXNews.com reported Monday. The substance in question: a Jolly Rancher candy.

A teacher confiscated the unopened piece of candy, and the 10-year-old girl, Leighann Adair, served her detention during lunch and recess last week.

She and the friend who gave her the candy were told to write an essay about what they did and why it was wrong.

“It’s an extreme punishment for something so small,” Michael Brazda, Leighann’s stepfather, told FOXNews.com.

Despite Leighann’s parents' pleas for leniency for a girl they say “has never been in trouble before,” school officials from Brazos Elementary School are standing by the punishment. They argue that they need strict punishment to effectively enforce their no-gum, no-candy policy, which can cause a mess.

The superintendent for the Brazos Independent School District also claims the district is simply following state guidelines to limit the amount of junk food in schools.

“Whether or not I agree with the guidelines, we have to follow the rules,” Superintendent Jack Ellis told KHOU-TV in Houston.

But state guidelines for punishing students with junk food don’t even exist, Texas Department of Agriculture spokesperson Bryan Black said.

“Our policy does not prohibit from sharing a Jolly Rancher with a friend,” Black told FOXNews.com. “If a parent wants to pack candy, it’s their decision, not against school policy. A parent needs to decide what a student eats.”

Officials from the Department of Agriculture sent a letter to school officials, reminding them that state policy doesn’t outline such punishments.

“What are they going to do, have candy sniffing dogs next?” said Leighann’s mother, Amber Brazda, said.

“I will put her in a private school if I have to.”

Something must have changed since I went to school. When did individual parents get to set or decide which rules their child gets to follow in public schools?

Though, I highly doubt this kid was served detention for that alone.

According to the Internal Revenue Service, the 400 richest American households earned a total of $US138 billion, up from $US105 billion a year earlier. That's an average of $US345 million each, on which they paid a tax rate of just 16.6 per cent.

started taking place when authority was taken away from the teachers. They are no longer allowed to yell at or discipline students. The only punishment that is given out anymore is this 'in-school suspension' BS.

No more making students stand for sleeping, no more making them sit in the corner of class for getting out of hand..

Too many nagging idiotic parents throw a ###### fit when their 'baby' gets yelled at.

How did FOXNews even get hold of this story? I'm betting the parents wanted their 15 minutes of fame. Losers. For an hour of detention, she will pay the fees for a private school? Lady, if she takes after you, a private school education will be wasted on her.

It's so true. My old man would have been embarrassed for coming down and me wasting his time. The teacher was a professional and an adult, therefore, was to be respected period. Rules were not negotiable and an adult, well a real adult, would never come and defend me for breaching them. Let alone report it to the news. Then again, what do you expect from Steven-esque parents?

What the hell are we teaching kids nowadays? That they get to make the rules as they see fit. Learning discipline has been an integral part of humanity and any culture for thousands of years. Yet in the last 20 years in western culture, it has been thrown out the window and replaced with my child's ###### don't stink, my child does no wrong and he's right the adult is wrong pedestal parenting.

These kids are going to grow up and not give a #### about anybody but themselves.

I think uniform food/drink rules are silly. When I was in school, it was up to the individual teacher the rules for their classroom regarding such things. Some allowed bottled water, some allowed snacks, and some didn't. Just depends on what they felt like dealing with.

I'm just stating what's been going wrong in schools with kids over the years... my opinion on the rule makes no impact on that.

Yup, head out to Sams Club for a big box of Twinkies, Cup Cakes and HoHo's to sell at the 'bake sale'...

oops... I bet HoHo's are not allowed any more cause they are not PC.....
