Wrong Name on I-129

I sent in the I-129 for my fiance and her daughter. I put her daughters name on the petition including her fathers last name and her mothers (they are from Mexico). Her mom thought she had to get sole custody of her daughter and got a lawyer in Mexico. He told her that suprisingly she doesn't need to do anything! he never signed the birth certificate, and has never been involved in her life! so my question is... how do I change her name on the petition? will this add time to the process? do I just wait until the Visa stage as they will issue the Visa with the name on her birth certificate?

Please Help!!!

Maybe I'm misunderstanding something, but wouldn't her daughter's name be whatever she uses as her legal name, regardless of whether or not her father signed her birth certificate or has been involved in her life?

It is a little more complicated than that... he did sign a Birth Certificate like 6 months after she was born, that's why she retained an attorney to get custody (she assumed she would have to). The attorney told her that the Birth Certificate he signed isn't valid, why I don't know (I think it had something to do with herBaptism). The bottom line is that her Birth Certificate doesn't have his name on it, nor will her Passport. My issue now is that her name on the I-129 does not match her Birth Certificate, Passport, who, where, when do I address this, and does it add time to the process.
