My fiance and I are about to submit the 129-F petition and we know that it can take several months for that to get processed. He was hoping to come over for a visit during the summer, but it's unclear as to whether he will be able to while the visa is processing. Has anyone been able to do this successfully or know where we can find out the correct information?

This is a very common question, if you do a search you can find lots of answers. The short answer is: admittance and duration of stay is up to the border agent at the time of crossing (OK, not so short of an answer). Bringing strong ties to your home country will help, as well as bringing a copy of the petition.

You might want to try posting this on the UK forum to get more specific answers about what to expect

Good luck.

Hi magsk. I am giving you a link to a 12 page thread in this same forum discussing this very topic.

http://www.visajourney.com/forums/topic/67796-yes-you-can-visit/

As the previous poster mentioned, the fiancee can fly into the Port of Entry but is not guaranteed admission into the US for being a risk to overstay the visa.

Also, as your fiance(e) makes more trips, say two to three, the CBE officers are likely to say OK, that is it, you are starting to abuse the privilege, don't come back for 6 months or 1 year.

I do not have first hand knowledge of this. This was in a few postings mostly from West Europeans of their experiences.

Good luck.

I've been over to the US each month since filing the I-129F in January and have had no problems with immigration under the visa waiver. My guess is that it'll be fine until the visa is inserted in the passport. I'm not sure if the border guards are aware of the petition but my entry has seemed easier (less questioning), but that might just be coincidence.
