I was fresh out of college when I left America for Japan. I don't have anything in terms of property there (house, rented apartment, car, etc.). One bank account with my parent's address on it, my voter registration, and my valid driver's license is all I've got. Is that enough? This is what my letter of explanation looks like (I nabbed it from someone on the forums here!).

I, XXXXXXX, am currently residing in Japan with my husband. Below you will find a list of attached documents to show that my principle residence is in the US and the steps that I have taken to return to the US with my husband.

Steps I have taken to maintain US Domicile:

• Maintained my voter registration

• Maintained my bank account at XXXX Bank

• Maintained my California driver's license

Supporting Documents for the above steps I have taken:

• Voter registration card showing US address

• XXXX Bank statement showing US address

• California driver's license showing US address

Steps I have taken to return to the US to take up residence:

• Made arrangements for us to live in my parent's house until we have signed a contract for our own apartment in San Francisco

• Will actively be job searching closer to the date of departure from Japan in October

I declare that I intend in good faith to re-establish my domicile in the United States no later than the date of my husband's admission into the US.

I certify under penalty of perjury under the laws of the United States that the statements in this letter and all accompanying evidence are true and correct.

Is this enough to get me through? If it isn't, is there anything else I could use, keeping in mind I've got nothing of significant monetary value in the States?

03-08-10: Got married in Tokyo at the ward office (just the two of us)

03-22-10: I-130 appointment in Tokyo

04-14-10: I-130 cleared, received letter in mail

06-07-10: Final interview... Approved!

06-08-10: CR-1 Visa and mysterious brown envelope of power received... they are fast!

09-30-10: POE at LAX. That official sure was rude!

10-20-10: Received Permanent Residency card (w/conditions).

10-30-10: Wedding in front of family and friends in Los Angeles

11-15-10: Moved to San Francisco

07-??-12: Applied to remove conditions on green card

12-27-12: Moved to Los Angeles

03-07-13: ROC approved!

I really like your letter. I think I will modify it and use it as well!

I have a question, thought this might be a good place to put it...

Does anyone think that obtaining US citizenship for our child would count as intent to re-establish domicile in the US? Or maintaining domicile in the US? Or should we just leave it off the list of things we have done?
