Hello. I am a USC and am dating a UKC. He is currently in the British military and will be for a few years. We are intending to marry before he is discharged but not sure about when would be the best time for apply for the K-3 spouse visa. I do not want to apply for it too early as I do not want it dismissed before he can actually come to the states permanently and I do not want to apply for it too late so that we have to wait a year or more to be together in the same country. In preparation for all of this, can you please provide some advice as to the best course of action to take?

Thanks

K3 is obsolete, you will be filing for the CR-1 (or IR-1 if married longer than 2 years). It usually takes 6-8 months to get approved, and he then has 6 months to use it, so figure out when he'll be ready to move and filesome10 months ahead of that. I suggest keeping an eye on UK timelines in case things change by the time you'll file.

Good advice. Start by studying the CR1 guide by clicking on the word "Guides" at the top of any page here. Bear in mind that US Citizens do not apply for visas. You will file a petition for your spouse. Once the petition is approved, the foreign spouse is invited to apply for a visa abroad.

Facts are cheap...knowing how to use them is precious...
