I am a Canadian in the US on a F-1 student visa. Getting married in the US in July (will enter the country on that visa?) Can anybody please advise on how you would go about that situation in terms of applying for permanent residency. The student visa expires 2 months after we get married??????

Once you marry, your husband will file the I-130, G-325A, and the I-485 and supporting doucuments, to adjust your status. Do this right after you marry to prevent any inconveniences or falling out of status. You may also apply for the Advanced Parole (so you can travel) and the EAD (so you can work). Follow the guides for the adjustment of status (although the guides deal with adjusting from K-1 or K-3, the forms should still apply to you.

Where are you getting married? I suggest you get married in the US so you don't have to deal with the 'entering on non-immigrant visa with the intentions of immigrating' visa fraud issue (way too much to worry about - entering on a student visa with the intentions of immigrating. Also, many times in Canada the marriage certificate will be issued 6-8 weeks after the marriage and this will delay your adjustment of status.

Hi,

When you say "will enter the country on that visa" - what do you mean? Are you not in the U.S. right now?

Get married in the U.S. and file AOS. It'll take quicker to complete the process if I am not mistaken.

It took only two (2) months to be approved. Hooray!

December 5, 2009 - I-485 application was submitted.

January 12, 2010 - I-485 application was re-submitted due to address error.

January 20, 2010 - I-485 application receipt notice arrived.

January 25, 2010 - Biometrics notice arrived.

February 9, 2010 - Biometrics taken at local USCIS office.

March 5, 2010 - Initial Interview notice arrived.

April 15, 2010 - Employment Authorization Card arrived out of blue.

April 29, 2010 - Initial Interview scheduled and... APPROVED!!! :) Conditional GC will arrive in 2-3 weeks.

April 30, 2010 - SSN reactivated. Newly printed card will arrive in 3-5 days.

May 7, 2010 - Welcome Notice arrived! Hooray! :)

May 8, 2010 - Freshly printed SSN card arrived.

May 26, 2010 - Conditional GC issued.

i will remind that advising an individual to commmit immigration fraud is a violation of terms of service on this site.

this individual has stated his intent to enter USA on F1 with the intent to marry and adjust status. subsequent posters are advising that he do so and file to adjust status within the USA. this is immigration fraud (entering on F1 with intent to adjust status by marriage).

OP, how about doing it the right way? you can enter USA, marry, file CR1, and return to canada for the interview. this is the safest option with least cost and inconvenience. adjusting from an F1 could be seen as fraud and result in an entry ban if so ajudicated.

An F1 is not a B2. The F1 is temporarily living in the US with permission of USCIS. To suggest to leave the country after getting married and interrupt heir life is a bunch of you know what.

Get married, file for AOS.

Hi,

When you say "will enter the country on that visa" - what do you mean? Are you not in the U.S. right now?

Correct, I will be entering the country just before getting married, it is summer vacation from school so I am in Canada. I really am lost and have no idea what to do. If I do file for AOS, how long until I will be allowed to work?
