I'm not sure what you're asking here, what is the exact wording on the form that you're looking at?

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card

The requirement about a person has to wait for 5 years since getting green card through marriage. Can this mean a USC cannot file for a spouse until waiting 5 years of getting green card?

I don't understand what you wanted to know.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

A permanent resident or a USC can apply for a spouse using the I-130. However if one is a permanent resident it is subject to a priorty date and a visa number becoming available. Once one is a USC they can update their case to show such....at which time there is no longer a priorty and no waiting for a visa number to become available.
