Danger of temporarily coming to US on K-3

Hello.

My wife was planning on coming to the US for the first time in late March. But her friend in Peru wants her to travel with her to Mexico in a couple weeks. She wants to stop in Miami first for 1 day before going to Mexico for a week. Then they'd return to Peru.

Would this cause any problems for my wife when she comes here for good at the end of March? I'm wondering because she has a K-3, not a tourist Visa, so they may be wondering whey she's coming to Miami for only 1 day. thanks.

Welcome back... haven't heard anything from you for a long time. With regard to your question, I do believe that k3 visa is a multiple entry visa. Your wife may go back to the states at anytime.

Or maybe someone who is knowledgeable in this area will help you :thumbs:

Hi Sheila,

Yes, I am back! My interview went well. I was just dealing with health problems as of late. My wife will be here the end of march, then it's on to all the Ajust. of Status paperwork!

Grant, they don't wanna know how long she's staying. If she's only staying for 1 day then she may. She will just "activate" her K3 basically. She should plan in a few more minutes for that but it's not a biggie.

she can leave the US right away and come back whenever she's ready to.

since she has the k3 visa.. you do not have to wait you can file the AOS while she is gone... She only needs to sign it and mail it off.. By her leaving the country will not be considered abandonment... She is a K3 they can leave and come to the U.S no matter what... So, filing the AOS now will not violate anything.. So, you should file this now before she leaves...

I think this matter was settled. Grant wanted to know if his wife had to activate the visa for this passing-through or if she could go through the transit line.

There is no more transit line so the visa will be activated upon entry to the US.
