well

sorry for late report on my interview

i was denied

so been trying to cope and bring my spirits up

went to interview thought i had everything turns out i didnt

they wanted a hand written permission letter along with copies of my kids dads photo ID showing his signature and that he gived permission for child to move to usa

the custody letter from queen bench of canada was not good enough or was the parental agreement we signed at queen bench which both state i could move child to usa

it was a real let down

well i have sent the paper they wanted they received it 2 days after my interview

not sure though if i was suppose to send passports back

cause they gave them to me at interview and said to get a hand written letter and notarized along with copy of photo Id from childs father which i did and sent immediately.

but should i have sent passports too??????

now im so lost

help anyone

anyone know how long this now could take???

im just so heart broken

i waited for over a year for this interview and only to be heart broken

Sorry about the initial denial, but i was wondering the paper you have from the queen bench is that the same thing as a court order agreement.

As far as sending in the passports back with the letter, I sent mine back with the paper I needed to send in. It might take awhile to hear back from them and then sending in your passports most likely add again a bit more time. But it may not.

yes i had a court order as well as a parental agreement which is signed by 2 laywers and myself and the dad and filed in queen bench of canada

but it was not accepted at interview

they wanted a hand written consent letter from the father and proof of his signature

which i sent by over night mail to them (montreal) as soon as i got home from montreal

i did not send passports as i was not sure if i was suppose to

i hope it not delay and longer

any idea how long it takes after you send in the paper

i am going to send my passports overnight mail this monday and attach a letter and case number

i want this to end very soon

it been very depressing and heart breaking for myself and two kids and husband(stepdad)

how long this type of delay usually takes do you know

anyone else been through same

please give any help

Hi smurfette,

Sorry the interview didn't go as you planned, however don't be discouraged.

The information they have asked you for - you have and it was easy to get - so that's great. The interview is not the end of the visa process, it's just a chance for the CO to talk to you and ensure you have all of the information they need, if they don't they request it - nothing more, so try to stay cheerful! You have had your interview so that's all done, now once they see the documents they will issue your visas - so it's actually good stuff!

Yes, I think you should have sent your passports and you should send them now, since you didn't. They can't issue the visa without them.

From what I have read lately it is taking up to 7 weeks for a turn around when extra documents are submitted, of course it could always be less or more, but that seems pretty standard.

Hey Smurfette,

This really sucks...and is totally crazy.

I'm in the process of bringing my son to the States. He is 12. I was told by DOS that all I would need is a notarized letter from his mother saying she gave her permission. I have that and submitted it and it was accepted by NVC.

If the consulates can't standardize what is required, how is a person supposed to prepare?

Your denial really has me worried now. I actually sent an e-mail to my Senators office, explained what happened to you and also what I was told I needed by DOS. I have asked for written clarification of what they will want when we go to our interview.

I notarized letter and all that you provided should have been more than sufficient. Immigration really needs to get their act together.

That sounds very civilized Darnell, but this is Montreal we are talking about :hehe:

Most of the time, well pretty much all the time, when someone here has been asked for extra information, the CO just keeps the passports. Why this one didn't I have no idea.

In cases where the applicant has to submit further information, people normally send the passport in with the info, so we don't really have any history with people getting a 'call in letter'.

What we do know is it takes Montreal weeks to review info - their mail is sitting in a pile, so if the passports aren't sent in right away, who knows how long it will take for them to get them.

I'm glad you contacted your Senator's office, will be interesting to see what feedback they get from Montreal - yes, it's not nice to be surprised by the CO on interview day. The 'official' word is that court certified documents, stating the immigrating parent has 'sole custody' should suffice.

Smurfette, do you have sole custody? You didn't mention.

If the parent does not have sole custody then the consulate will request written consent, which must be notarized, i'm not sure what the "parental agreement" was that smurfette took, is that a form of some kind?

To prevent international child custody disputes, in cases where a divorced parent wishes to have his minor child immigrate to the United States, U.S. diplomatic offices in Canada will request original or court-certified copies of court orders regarding child custody arrangements. Such documents should specify that the parent has “sole custody” of the child. If a divorced parent does not have court-granted sole custody, U.S. diplomatic offices in Canada will request written, notarized consent to the child’s immigration from the other parent

yes i have custody

i only wish i had known to bring letter from dad

cause he signed it and notarized within one hour of me coming out of interview

i sent it overnight to montreal

they have received it

now monday am i am sending in passports

overnight delivery

i really hope it faster then 7 weeks

my gosh

i am so heart broken just want to get children enrolled in school in usa before the end of the school year there

is there a number i could call to see if i am suppose to send passports

on the letter from the interview that day he handed the passports back and the letter requesting more info

which says a letter notarized from biological father and copy of his ID with his signature

that was in first box marked with X then under other marked with X it says 3 canadian passports , which i had given him but he returned them

so i wasnt sure if i was to mail them back with the document they required.

so i am just sending them in monday

sad thing is if it takes long i cant go visit my husband no more

so heart breaking

the parental agreement i have is filed in the court which states the child is able to move to usa with mother

it signed by bio father and 2 lawyers as witness.

i just wish i had known to bring the simple letter that montreal wanted

i waited over a year for interview around something so simple i would have had

now im stuck waiting further for something that could have been brought cause it was obtained within one hour after interview

i wish canadian could cross border by land with out passport

would make this a whole lot easier

knowing i cant go see my husband kills us

Yes, you can call the Department of State:

Phone: 202 663 1225

When you send in your passports Monday, be sure to include your case number and also a letter explaining that you have already submitted the additional evidence but you neglected to send the passports.

I had a notarized letter from my kids father giving permission for them to move. In the letter it also stated that the notary check his ID and that the signature was his. I didn't have any problems.

Montreal seems to jump around with what documents they want. We had a woman interview us. Not sure if it matters who the CO is.

Hope they get to it soon smurfette.

I just find it weird that they want a hand written letter from the dad notarized, when they had a court document with allowing the move to the US. When I was in the process of trying to get my ex to give me a letter my lawyer wanted a court order. She said she didn't trust just a letter and the border officials could deny it anyways. Saying a court order trumps all. Maybe I'm missing something about yours, did you have a Judge sign off on it. Mine had a court seal and Judges signature. Maybe that makes a difference. I still can't see why a notary would be better then 2 lawyers.

Anyways back to the passports. When I went to Montreal at the end of the interview all our passports where returned. But before I left the room I read the paper she gave me and noticed it didn't say to return the passports back either, she was still in the room so I asked if she wanted them back too. She sorta just said I could send them back. It took 4 or 5 weeks to get them back. This was 2yrs ago and things are slowing down again.

I am sorry about the dissapointing interview Smurfette, send the passports ASAP with an enclosed cover letter. Perhaps e-mail montreal as well and let them know you have submitted the passports after the fact..
