I 134 question

Timeline

OK Guys here's my question:

my man (the USC) got laid off in May and has not found a new job so far,but it looks like he will have one with USPS real soon.Now we want to put the I 129 in by November 1st,so it'll be about two months (maybe less) that he's in the new job.(Which will put us well above the 125% for the 2006 Poverty Guideline).Does this matter? Do we need a co sponsor? Or can we try to just send his stuff (whatever he's got until Novemeber 1st as far as Pay Stubs go) in?Will they give us an RFE in case we DO need a co sponsor?

We would actually have one but I wanna try and leave our friends out of this as long as this is possible and not REALLY necessary.

And does the Embassy in Germany require an I 134 or an I 864 for the petition?

Any helpful replies are welcome.

i had a similar situation, actually. when we filed our K-1 petition, i had only been in my job for a short time, and i hadn't made that much money yet. i had been off work, caring for my terminally ill father, and so i included a letter with the application packet explaining that fact. i also included my current pay stubs, and a letter from my employer stating my salary and hire date.

i did take information along with me to the embassy for the interview from my mom, just in case they asked for a co-sponsor, but we were approved without them asking.

As far as I know you don't get an RFE if you need a co-sponsor. If you don't meet the requirements, they can simpy deny the visa. I would think it doesn't matter how long the USC has had a job, provided the requirements are met.

According to this link, you'll need I-134. From the form:

The sponsor must submit in duplicate evidence of income and resources, as appropriate:

A. Statement from an officer of the bank or other financial institution where you have deposits, giving the

following details regarding your account:

1. Date account opened;

2. Total amount deposited for the past year;

3. Present balance.

B. Statement of your employer on business stationery, showing:

1. Date and nature of employment;

2. Salary paid;

3. Whether the position is temporary or permanent.

C. If self-employed:

1. Copy of last income tax return filed; or

2. Report of commercial rating concern.

Some embassies will settle just one or two of the evidence listed. Some will need more. I guess you'll get better info on that by contacting the embassy or other VJs going through the consulate in Germany.

I only offer advice - not even legal. Just the plain and simple kind.
