I'm looking for advice about whether my fiance and I should file the 129F as soon as he gets the copies of everything from me or should we wait until I am there with him.

I'm planning to spend 6 weeks with him in September - October and not sure if it would be easier at POE not to have any record of a K-1 on file or if having filed for a K-1 would be evidence of intent to follow correct legal procedures.

As it is I expect to be able to send him copies of all the documents he needs in the next week to 10 days, delay would only slow our ptetition by a matter of 2 or 3 weeks but at this point I am most worried about getting denied at POE.

I have only visited for one week so far this year but last year had three trips totalling over 3 months in the USA. I plan to bring my lease and an employers letter showing I have a new job to start when I get back to the UK.

What do other people here think?

i think it's all dependent upon how much you're willing to risk. when anthony and i were going through the k-1 process, we decided that it wasn't worth the risk of being held back at the POE, and so i traveled to ireland twice during the application process instead.

at his last visit prior to filiing for his k-1, he was held at the POE and questioned, as to why he had been in the US so many times recently, etc...so it made us a little gun shy.

that said, if you do decide to travel to the states while your application is pending, bring proof of your intent to return. you also may wish to consider traveling through Dublin. they have a US port of entry in the Dublin airport. that way, if you were to be turned back, you would still be close to home. :lol:

Thanks for the help, the worst time I had at POE in Philly was on my first trip, that was a longish trip and at that point I couldn't even prove I had a job to come back to. I did think about using Dublin but the cost is prohibitive. My fiance traelling here isn't an aption for the forseeable future as he is recovering from major surgery and he could never cope with a transatlantic flight, he can just about handle car trips as long as they are less than 2 hours.

I count myself lucky that we are going to miss the worst of the IMBRA problems.

I want to minimise risks as we both are looking at being together long term and don't want to do anything to jepordise that.

I agree - that's what I would probably choose to do if I were you. :thumbs: It sucks to wait, but it'd suck even more if your plans of staying here with him for 6 weeks got ruined.

This sounds like a good idea, I had thought I would be OK just bringing copies of the documents needed but if I could just avoid the whole question by not carrying them things could be much easier.

I've waited so long already I want to make sure I don't do anything to mess things up now.

Oooooo i definitely would not be carrying paperwork in my bags. There was a gal here (from Scotland in fact) who was a 'frequent flyer' and she came across carrying her papers. Got turned back. In Dublin.

Of course she had spent like 9 of the last 12 months in America also. A bit more extreme than your case!

I strongly suggest you fly into Dublin if at all financially possible. If you have good proof of returning to the UK, I think you'd have a better chance of NOT being turned back there. There is another VJ member who visited his fiance often and he managed to get thru Dublin each time - he had a loooooooooong interview the last time they let him thru but it worked for him nonetheless.

I am in the same situation as you, so rather than have any issues at the poe we are gonna wait till after my trip in September.

I talked through the relpys here with Richard and we have decided to file after I arrive.

Now I just need to convince him that we can do that as soon as I arrive, he has this idea that everything will be processed within days and that my being with him could mean I miss the next stage in the UK.

I love his optimism even when I want to shake some realism into him. :D

I'm going to be with him for a total of 6 weeks. I remember the old days too but I don't expect to see them back this soon even though he will be filing through Vermont.

Could happen. When my hubby (then fiance) was here last summer we made arrangements with a family member. They watched for the Packet and Fed-Ex'd it to us. But he was here for 9 weeks, not 6. I don't think you will lose more than a week or two if the visa gods smile on you with an early Vermont approval.
