Evidence of a Bonifide Marriage

The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bonifide marriage. What evidance do we need ? She lives in morocco. I live in the state Thanks

Wedding photo's, letters from friends/relatives, receipts, marriage certificate....

01/2006 - Filed k1(1st time)

04/2006 - Interview (1st time) denied

Waited, waited...... no review

06/2009 - Filed k1 (2nd time)

09/2009 - NOA 2 approved

12/2009 - Interview (2nd time) APPROVED! VISA ISSUED

02/2010 - Arrived USA

04/2010 - Married

4/19/2010-Sent to Chicago Lockbox

4/26/2010-Received texts and emails 7th day

4/30/2010-Received NOA's(Hardcopies) 11th day

yer timeline indicates SHE received a K-1 visa on 2010-02-12.

Unless something is really f'ed up with HER approved K-1 visa - or unless you two were married in Morocco after 2010-02-12 -

you don't need to file the I-130 at all.

She has 6 months from 2010-02-12 to arrive in the USA, then you two have 90 days to get married, then ya gots to file the I-485.

No I-130 required , unless you went back and married her in Morocco (or unless she came to USA, you married here, and she returned to Morocco prior to receiving the greencard).

Look in the guide section here also, there is list of things. The only thing I would mention in regards to the list is that it says Items 1 or 2 or 3 or 4 or 5 or 6.

Because of the consulate you are dealing with I might suggest you make those ANDs and not ORs and provide as much evidence as possible. You likely wont have 1-3 or 4 so focus on 5 and 6.

1. Documentation showing joint ownership or property; or

2. A lease showing joint tenancy of a common residence; or

3. Documentation showing co-mingling of financialresources; or

4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or

5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or

6. Any other relevant documentation to establish that thereis an ongoing marital union.

I'm filling k3 for my wife in morocco. Do I need submit the photos and marriage certificate with I 130 or I129f or both? Thanks for your help

Hi Adam. Don't do anything with the K-3 - it will be administratively closed at NVC when the I-130 and I-129F arrive at NVC together (and they will arrive together unless you so massively messed up the I-130, that you got an RFE on the I-130) - see http://www.visajourney.com/news/2010/02/07/department-of-state-to-close-k-3-visas-if-i-129f-and-i-130-petitions-approved-and-received-together/ )

re: yer exact question -

PHOTOCOPY of marriage certificate (not certified photocopy, but must show the SEAL), is adequate, and must be submitted with both.

Same on the photos, but photos are optional.

Did you read the link I supplied, above, about what to include to document the bonafides of yer marriage?

If you've not filed the I-130 yet, STOP. take a few weeks to gather up the evidence that I listed in that link. Seriously.

ATTENTION: There IS NO K3 anymore for all practical purposes. You aren't paying attention.

Your responses indicate you don't yet quite understand what is meant by evidence of a bona fide relationship. Hopefully, you DO understand that it is the CR1, not the K3 visa you should be learning about.

Technically USCIS DOES NOT REQUIRE evidence of a bona fide relationship when filing the petition. ANYthing you read following the words "in addition to the required" is, by definition, NOT REQUIRED. Nevertheless, because it is Morocco, I would be very careful to provide MEANINGFUL evidence of a bona fide ONGOING relationship including a detailed evolution of relationship letter and evidence of all time spent together. One thing I would avoid unless it's a special case is an "affidavits" from others, particularly when they know no more about your relationship than that you seemed happy at some party or ceremony. These carry little weight and usually make you look desperate.

Photos, passport stamps etc. are good evidence of a genuine relationship but it is the time you actually spend together that is the strongest in this kind of case.

Facts are cheap...knowing how to use them is precious...

Thank you for your help . How long it normaly takes?

5-8 months from petition filing to visa interview if you use the NVC shortcuts. Then if there's additional administrative processing after the interview (common in Middle East and N. Africa) then several weeks to a few months more.

Facts are cheap...knowing how to use them is precious...

USCIS also sent me an RFE to ask for our orginal Moroccan Arabic marriage certificate because I sent only the ENGLISH translation which also had EVERYTHING important mentioned on it with the proper seal. Send both the ARABIC and ENGLISH copies. OUR CR-1 case took 4 months at USCIS and another one month waiting on Moroccan hubby to send Arabic marriage certificate. Also have her to send you the DS-230 form signed so when your case closes at USCIS and they forward it to NVC, you will AVOID the 3 week delay receiving the signed forms from your wife in Morocco. International mail is awful!!! Today is our 19 day waiting for signed forms from my Moroccan husband.....so it is delaying us getting a much sooner Interview date! Send EARLY cause the forms I mailed him also, got misplaced in Casa and cost us another 5 weeks! I-130 is the CR-1 if you are married. Once case is approved at USCIS, it will take 1-2 months for an interview date...maybe closer to 1 1/2 to 2 months....I would advise to wait closer to NVC stage to have your wife obtain her police certificates she will need at the NVC stage. Ours in Morocco were stamped for 3 months! So we paid for another moree current copy and I had him to send me both the Arabic and English translations. For each PAGE translated in Morocco, it will run you about $20-25 a SHEET!!!

You can use your trip itineries can also prove as evidence of trips there to see your wife....I also sent e-mails and chat records and phone records from start to current at USCIS, not sure if they were needed. I also sent a police report since I already had it here. I sent photographs of wedding and with family members and i sent copy of his and my birth certificate.....We received an RFE from USCIS, they requested our ARABIC copy of marriage certificate after sending only the English translation.....passport stamps, insurance cards like BC/BS....if she is on bank accounts or beneficiary of 401K or life insurance policies since you are already married....I also had a copy of his identity card and sent it since it was in my pocession already...letters from her or copies of letter you have mailed her or receipts of mails...receipts of money grams, western unions, etc......... maybe someone can add more to the list.
