Hello everyone!

I´ve been reading all kinds of information on this website, and so far it has been very helpful.

However, I still have some doubts, and hopefully someone can help me.

I am brazilian, and I spent 2 years in the US as an aupair.

I´ve met my boyfriend, just 4 months after I got there, and we´ve been dating since then.

I came back to Brazil 9 months ago, and my boyfriend has visited me twice, so we just decided to apply for the fiance visa.

Here are all my doubts.

1-I tried to get a B2 Tourist visa in March, and it was denied. Do you guys think I could have any problems on getting my fiance visa approved over that fact?

2-I spent two years living in Maryland, so how can I get my background checks over there, since I am here in Brazil?

3-I went to Usa on a J1 VISA, on my DS2019, it says I apply for the 2 years home stay rule, but on the stamp (my visa) on my passport it says I don´t, so would I have any problems?

4-I am filling up the G-325A form, I have a compound name, should I write the second name on the blank that says: "all other names used (include names of previous marriage)"??

On the section that asks about my last ocuppation, can I write down AUPAIR? so would the employee be my host family? or cultural care?

5-Should I send my birth certificate copy, and translated copy with the I-129F??? or just a certified copy of my passport would be enough?

Well people, I am sure some of you might think my questions are dumb, but this whole process isn´t easy...

I hope somebody could give me some direction.

Maybe - maybe not, what was the reason for the denial?

Birth certificate and passport of the beneficiary are not required for the I129f - only for the USC - the beneficiary will need these at the interview.

Well people, I am sure some of you might think my questions are dumb, but this whole process isn´t easy...

I hope somebody could give me some direction.

Denial of a Tourist visa will not affect your K-1 Visa/process. We had the same experience and concern. The IO in Brazil asked my fiancée and she was honest why we applied for the B2 first rather than the K1..

My husband must have had about 7 visitor visas denied over the years. He tried a lot of times to come visit the US as he has an uncle here. But being Nigeria visitors visas are hard to get. I am sure that is true of a lot of African spouses. It is not a problem.

This will not be over quickly. You will not enjoy this.

The most common reason for a B2 visa being denied is that the applicant couldn't prove strong ties to their home country that would compel them to return before their stay in the US expired. If that's why you were denied then it should have no effect on a K1 visa application. If you were denied for some fundamental inadmissibility, like health or criminal problems, then that would affect your K1 application.

If you're referring to police certificates, you don't need to get one from the US. Immigration and consulate officials will have access to any records they need from the US government.

What does your IAP-66 say? If both the IAP-66 and visa say no home residency requirement, then there is no home residency requirement.

You should write your legal name on the G-325A. Usually, this is the name that appears on your birth certificate and passport. If you have used a different name for any reason, whether it's your compound name or a shortened version of it, you should list it under "other names used".

You don't send either one. The US citizen petitioner will send one of these for himself to prove he is a US citizen. Your documents won't be needed until the interview. The only thing you need to provide for the petition is a signed G-325A, a signed letter of intent, and a couple of passport style pictures. If you've ever been divorced, then you also need to send a copy and translation of your divorce decree.

Your employer is Cultural Care, not the host family. Also check on your DS2019 if you have the 2HRR. They will ask you a copy of that too. So send it with your application.

And yes, you can write "au pair" as last occupation.

Don't send any original certificates to USCIS. Send them a copy and bring the original to the interview.

hey

I was au pair too for 1 year and if it states on the visa that is attached in your passport that the "2 year rule does not apply" then you are good.

You'll have to send a copy of that visa to your embassy in brazil at some point and that's all that matters to them.

Also I put my hostparents as my employer and never had any problems with that.

A denied tourist visa is no reason to have your fiancee visa denied.

But be prepred that they could ask about that at the interview.

I was denied a tourist visa and had no problems at all.
