Will my classmate be able to bring a girl to the US?

The joker came to the US in 1999 and married a USC years later and became a citizen. They have since divorced and in April he went to his native country (India) and married a girl he had a kid with.

Will he have problems with his I-130/K-3 visa?

Last night he told me that he was having a problem interpreting the I-130 form which seems to imply that he cannot apply for the I-130 because of #3.FOR WHOM MAY YOU NOT FILE? Though he is USC, he got his GC via marriage and it seems its less than 5 years since he became GC holder.

If he is a USC and the marriage is legal he should have no more problems than anyone else.... there are many many people on here who have been married before....
