The good ol question; what was first... the chicken or the egg.

Me Dutch guy and my wife (American citizen) are happily married and living in the middle east, wanting to start DCF. Now for the intent to move to the States we are facing some challenges, we hope someone recognizes them and can give us some tips.

As for me I do have applications out in the States but i do not think they will hire me since i do not have work authorization.

My wife works over here and would like to move back to the States with her present employer but thinks its too early to bring this up to her employer.

Any other ways how we can prove intent?

Any thoughts are appreciated.

Intent for what? No demonstration of intent is needed to file an I-130 petition for spousal immigration...

Do you mean domicile?

Yep - it looks like establishing domicile in the US would be your 1st challenge at this point.

Hi and welcome to VJ,

You might want to start by looking at this thread - it's kind of long but if you read the first page and then skip to the last page, on the last page there is a link of reviews etc (feel free to read the whole thing lol)

Now this is mostly people who have interviewed in Montreal. Montreal is VERY strict about the domicile requirement, most other consulates do not take such a hard line, from what I have read, so don't let it put you off too much!

Oh and just to clarify, you are not trying to prove domicile as such, you are trying to prove reestablishing domicile.

Proving domicile when not living in the U.S.

Yes I am talking about intent to move to the States as soon as the visa is approved.

Intent is not an issue... having your USC spouse being your qualified sponsor is another compeltely different question

I had a similar situation, what i did was had my sister write a letter saying that we plan on moving back temporarily with her, until we get a place of our own and she wrote her contact details incase they needed to call her and signed it. I'm a medical dr also and i wrote them a letter saying that i plan on specializing in the united states and that i was currently taking my united states medical license exams, well it worked out because my wife got her visa stamped on her passport. Try to figure something out similar to that and hopefully it work. They did at the time give me a paper explaining what a domicile is and that you have to be able to show that your willing to leave your current job and take your money with you etcc etc.. though i wasnt working at the time. Other things i've read when i was reading about that topic, is that the US citizen can actually go to USA first and then "establish a domicile" eg.. open a bank account get an address etc.. but I know thats a pain so try to figure out something like what i did eg. by writing a letter and have someone in america write a letter that your gonna stay with them temporarily etc.. and hopefully that'll work good luck!!

This coming july we will file DCF and we will make sure to set up a time line and share our experiences.
