No Progress Thread for AOS from Student, Visitors etc

I did do a quick search to see if anyone had asked this but couldn't find anything.

Basically a point was raised in the AOS from Family Based Visas progress and case filing reports that the "other" April AOS filers thread should be merged with ours.

I pointed out that there are some differences so I think they need to be separate and that's when I noticed the AOS from Students etc one doesn't actually HAVE a specific "case updates and progress" like it does for AOS from Family Based Visas so the updates are posted in the regular "question" area.

I also noticed that the AOS from Family progress one is only called "Adjustment of Status Case Filing and Progress Reports" so when you see a post in the "new content" area you can't tell it is supposed to be specific to family based AOS'ing until you click on it and notice the thread path makes it a sub-forum of the AOS from Family Based section...

So, is there a reason why the AOS from Student doesn't have their own Progress & Filing reports section? Are they supposed to share the family based one? If not, why is the Family based on not called "Adjustment of Status from Family Based Visas Case Filing and Progress Reports" so in the New Content area you know which one it is(Yes I know it's wordy but apparently AOS is used interchangeably with Affidavit of Support AND Adjustment of Status so people might get confused.. though personally AOS = Adjustment of status and I864 = Affidavit of Support)

Thanks in advance :)

V* :)

I remember when the sub-forums were added but forget why some didn't get them.

I don't think it would be a bad idea for there to be "Case Filing/Status Report" sub-forums for some of the other forums (Student/Tourist, ROC, etc). I think it is helpful both for the members to find information/post topics and give folks a place to post their progress. (Just like members can in the upper forums.)

I vote "no" - since they didn't follow the rules like everyone else, they shouldn't get to gloat about it....

(just kidding)

sounds like a great idea. good.gif

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS

Would it make sense to have one AOS heading, instead of two, with 3 subheadings: Family-Based; Other; Case Filing and Progress Reports?

It does make sense BUT then you would have the AOS from Student and AOS from Family in the same Case filing and progress area... and there are some subtle but important differences between the two which could end up confusing people... one important one being the majority of K1 filers do not require an interview for AOS... but the Student ones do have interviews.

I think if there were new people trying to AOS from Student etc visas and they went into a "co-mingled" case filing etc section and saw that people weren't having interviews they would think it applied to them. Of course they'd realise later but the Student ones also send in a I-130 where family visas don't so they'd get updates on those forms... I think it's just courting confusion.

The 'majority' of K1 status adjustees do not have interviews? Well that's quite a revelation. Have you statistical evidence for that? The last time I checked it was pretty much 50/50 odds for an interview.

The only reason there is a separate forum for filing from student visas, etcetera is that these individuals were getting attacked by members who had come on a family based visa.

Adjustment of status is adjustment of status, Vanessa. It's really pretty vanilla no matter how you slice it.

Our journey together on this earth has come to an end.

I will see you one day again, my love.

No evidence except that just about every single K1 recently has been approved after it being sent off to the CSC without interview... Is there a way to use the timelines to see who has and hasn't had an interview and is approved?

In either event then I amend what I said to "50/50 odds for a K1, 100% odds for "the others" that they will get an interview

You know now that you mention it, I think I remember hearing about that a while back.

Well I can't see how you processed so I can't know if you actually have experience with it but I disagree. They're mostly similar but still different.

BUT if your statement regarding "abuse" of the student etc visas is true, then all the more reason to maintain separation.

Vanessa if a case gets sent to CSC, there probably won't be an interview.

Not all cases go to CSC.

You're detracting from the point, which is this:

Currently there is no "case filing and progress thread" for AOS from Student, Visitors and Working Visas.

The only "case filing and progress thread" is in the AOS from Family based visas forum.

I think there should be a defined area for the AOS from Student etc's to discuss case progress etc rather than them putting them in with the questions.

Yes, just exactly what's needed around here, another sub-forum for people to compare case results and fret about their own case.

I don't agree at all with the concept of these time driven sub-forums. I've seen the people left at the end of a particular month with no resolution have near complete breakdowns because their 'filer buddies' are done and they aren't. I think it's so unproductive and IMO I'd like to see all of them dissolved rather than create another one.

Whatever happened to relying on the data gathered by Admin for projecting the time a case might be resolved?

Bah.

Thanks :)

I know some people freak out, it's bound to happen, but I really think the support of other members really helps people from stressing as much as they would if they relied simply on "projected" dates. Plus it's a good spot for people to celebrate each milestone.

Well the way I see it, a million milestone celebrations aren't worth the angst of one person.

But that's just the way I feel.
