Hello:

I called a Washington D.C. Visa Service number 202-663-1225. They mentioned the I 907 Premium Expedited Processing

service for filing a new I 130 for my infant son. Cost is $1000.

On this - I would call back, and VERIFY that this is possible for an I-130 petition for a CR-2 visa. Ask them that, specifically.

Good Luck with that phone call ! Also note - you'll get different answers, depending on WHO you talk to. I'd suggest calling 3 times, 3 different humans, note all of the answers, and THEN, call back - get a supervisor, and ask again.

Service Center Employees are trained to listen for certain buzzwords and ignore others - yer buzzword here was 'expedite' and I'm not so certain that they heard 'I-130' at all.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

** Duplicate topics merged into a single thread (post #10 the OP includes a bit more information). It looks a little out of sync, I know.

There is nothing out of sync. I just remembered the lady in Washington said I could

file a I 907 for premium processing. Didn't know how to add to original, so made a new

posting

Thanks, but how many more months does this take?

I have been there..done that! My case was a F2A which got converted to a CR1 visa for my wife. THey removed my son from my petition...Anyways to make the long story short, once I got the interview letter for my wife, I called the USCIS to expedite his I-130(I had filed it when I became a citizen in dec 2009), once they saw the reason that its for a 4 month old child, they approved his expedite.

Once USCIS approved the expedite, I emailed PL SUE to expedite his NVC petition and explained what had happened. The Embassy also knew of this during my wife's interview & was helpful in saying Yes for the expedite. Now I am waiting for my son's interview so we can all be united! Freaking laws! If you are LPR(green card holder), you can bring your child(up to 2 years) with a transportation letter, however you can't if you are U.S Citizen. Also if you are a LPR, all kids are derivates in the I-130 petition....Weird laws that U.S has put together in my opinion!!

USCIS\NVC Journey:

07/20/08 - Got Married

07/21/08 - Applied for I-130 for my wife as spouse of a LPR

09/14/09 - Birth of our Son in Italy

09/28/09 - NOA2. Approval of my wife I-130

10/20/09 - NVC Finally receives her case

10/21/09 - Added my son to her petition at NVC since LPR kids are derivatives

12/20/09 - Became a U.S Citizen

12/21/09 - Filed I-130 for my son

01/20/10 - Wife's case at NVC upgraded to CR1

02/28/10 - Case Complete

03/10/10 - Interview date received, April 15th, 2010

04/05/10 - Filed Expedite for my Son's I-130

04/08/10 - Expedite Approved by CSC, I-130 approved

04/14/10 - Medicals done for my wife and Son

04/15/10 - Wife's Visa approved

04/15/10 - Sent an expedite to NVC regarding my Son's case

04/16/10 - Paid IV Bills/AOS Bill for my Son's case

04/21/10 - Sent AOS/DS-230+supporting docs to the NVC

04/22/10 - Expedite approved

04/28/10 - Son's case file to sent to the Consulate, Italy!

05/06/10 - Consulate called to notify of interview date, MAY 20, 2010

05/20/10 - Interview - Approved

05/21/10 - Pick up Visa @ the consulate

05/22/10 - POE, WAshington Dulles!

05/22/10 12AM - Best Night of Sleep of my life!

Oh - I'm around - I've NO Experience with paying for premium processing - I thought premium processing was NOT available for any I-130 petition for spouse or child. I wrote up a lot on his prior topic - so

I'm hoping someone who DOES have experience paying this premium fee, will chime in.

IMO, the I-907 is for work visas - but I'm solely basing that on http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=79ef78264614d010VgnVCM10000048f3d6a1RCRD

If the OP is certain about this type of petition being eligible, then I've no real input about it.

In other errata - IF the OP is the biological father, and was a USC for 5 years prior, when the child was born, all of this is moot - he can file CRBA instead.

There is no such thing as paying for premium processing for an I-130 petition. If there were such an option virtually everybody would pay for it. Premium processing is available for $1,000 for an I-129 petition for an alien worker. We don't call the USCIS toll free number the misinformation line for nothing.

File the I-130 for the child as Darnell indicated, and request the expedite.

Do not ever give another second's thought to attempting to falsify a vital record from any government agency. The consequences can be quite severe.

Further, it is not helpful to post your interpretations of what was said. Your K3/4 was not converted to CR1. Your I-129F was administratively closed. The I-130 is the petition filed to result in either CR1 or CR2 in your case.

Anywhere from 5 to 13 months, depending on many things:

--which service center gets the I-130 petition (CSC is usually faster)

--use NVC Electronic Processing or not (shaves off waiting time between 'NVC OUT' to 'GUZ OPEN CASEFILE')

--any RFEs

--Successful Expedite Approval on the I-130 initial submission. THIS CAN BE DONE without paying a fee, btw.

--caseload at USCIS

--caseload at NVC

IMO, this I-130 for a CR-2 petition SHOULD GO FASTER through the system, even without the expedite, as background checks on you and the mother have already occurred.

You'll need to prep a paragraph on expediting in the cover letter for the submittal, and also a seperate letter requesting expedite as well. (IMO)

Thanks for your help and Information.

It has been a sad day so far. I thought we were almost homefree.

Hang In There !!! You can 'get the expedite without fee' , using the stuff I mentioned, above, and JimBoy's NVC step. Supervisor Sue, at NVC, apparently handles all expedite requests.

I appreciate your view point, I called the number listed, Washington D.C.. This Visa specialist suggested this

option to expedite the I 130 application for our young son.

The option doesn't exist. That's why we call it the misinformation line.

if you would take the time to read the I-907, you would find the I-130 is NOT listed for available expedite

YMMV

Well first thing you need to do is to file a I-130 for your step son ASAP with a letter asking for an expedite. Then you need to call the 1800 number and ask to be transfered to an officer. Calmly explain to the officer about what's going on, convince her or him to send an expedite request to the CSC. You will know the response in a weeks time by email.

Once that's done, NVC part isn't as hard because they are used to expedite procedures in cases like this or age-out cases. I got told by the consulate itself to ask for an expedite...meaning they are willing to help in these cases.

In the end, red tape or yellow tape...you will be united sooner than later...be persistent!!
