Hello,

I am writing to see if there is anything I can still do in relation to my wifes filing of removing of conditional status.

Currently I am deployed and have been for the past 7 month. Our application for her removal of conditional status needed to be in by Aug 3. I was not thier to sign the papers, but after contacting immigrations, checking online, ect it all pointed to stating that I am in the military and currently deployed, I did not find out about an extention till after we have mailed the package off.

Well today is the 5th now, and she just recieved in the mail a rejection package, stating that I needed to sign the papers and to refile by the due date Aug 3rd.

I dont have all the information available, but I needd to know what can i do, I am still currently deployed for at least one more month. Its saturday, and well you get the idea, any more information I can provide I will try.

Can you fax your wife a copy of your orders? If she takes this to infopass they should be able to make special arrangements for you. Maybe next time give your wife POA and she can sign on your behalf (not sure if immigration would accept that or not - they seem to have different rules for everything).

What if I am Late in Applying to Remove the Conditions on Residence?

If you fail to properly file the Form I-751 (Petition to Remove the Conditions on Residence) within the 90-day period before your second anniversary as a conditional resident, your conditional resident status will automatically be terminated and the USCIS will order removal proceedings against you. You will receive a notice from the USCIS telling you that you have failed to remove the conditions, and you will also receive a Notice to Appear at a hearing. At the hearing you may review and rebut the evidence against you. You are responsible for proving that you complied with the requirements (the USCIS is not responsible for proving that you did not comply with the requirements).

The Form I-751 can be filed after the 90-day period if you can prove in writing to the director of the Service Center that there was good cause for failing to file the petition on time. The director has the discretion to approve the petition and restore your permanent resident status.
